I know there are states and countries where the age of consent is low BUT the age difference of the partners is taken into consideration. So in some places your friend might be breaking the law if he went out (or rather went in?) with a 18 year old EVEN if the age of consent were 18. BUT his partner could have sex with another 18 year old without breaking the law.

Thats so dumb. from the mouth of an 18 YO who likes older men... quite abit older actually.
 
I was wondering if someone could clarify this one for me.

A close friend of mine is currently dating an 18 year old guy, and he's 32. He's recently wondered if it was legal for him to have sex with an 18 year old. I said to him that to my understanding, the federal age of consent in the US is 18. Even a 50 year old could have consensual sex with an 18 yo, and that would be legal. Am I wrong?

Yes, it is legal to have sex with an 18-year-old. You are considered an adult at 18, and treated like one; tho they don't always act like one.


btw, the age of consent in IL is 17.

It varies from state to state, in the USA.

Unfortunately, in Oregon (and for Portland's mayor), that age is 16! For such a "liberal" place, a stupid law.

It's odd, too, that in some states the age of consent is much lower for hetero sex than it is for homo sex.

What a strange world we live in.....

How do they determine what age difference is appropriate is beyond me. It all sounds too technical on a non-technical subject. Next they might take penis size into account, so as not to traumatize the newcummers.

That might be a big misinformation of the law.

He's thinking of the close-in-age exemption.

What that means, from what I understand, is that if the age of consent is, let's say, 14-17 in some places, there's a 5 year close-in-age exemption on that. So for example, the age of consent is 16 in Canada. That doesn't mean, I don't think, that a 50 year old could have sex with a 16 year old. It does, however, mean that a 21 year old could legally have sex with a 16 year old. It's about the number. Also, from what I understand (this is all coming from memory), if the age of consent is set at 18, then the close in age exemption doesn't matter, because 18 is also the age of majority. Something like that.

Either way, OP, your friend is fine if the guy is 18.

For the person who mentioned sodomy laws and the like, that might be true, but are those ever enforced any more? Wasn't Texas vs Lawrence a federal decision?

OK, basic facts.

Anyone over 18 is legal to have sex anywhere in the United States. Anyone over 18 may have sex with anyone else over 18, regardless of age difference.

In states where the age of consent is lower than 18, people over the age of consent are allowed to have sex with other people over the age of consent, but other restrictions still apply, hence my comment about being able to show someone your dick but not a picture of it (showing pornography to someone under 18 is illegal in the US).

In some states, there's an age range exemption when the younger person is below the age of consent. These are generally called "Romeo and Juliet" laws. These are intended to avoid prosecuting a 16-year-old for having sex with a 15-year-old. Other states happily prosecute such cases, apparently because they love to put teenage boys in prison on any excuse.

There used to be different laws in some states for gay sex. In most of them, the age of consent for gay sex was lower, or it was outlawed entirely, but e.g. in New Mexico the AoC for gay sex was 13! All those laws were overturned by the Supreme Court's decision in Lawrence v. Texas.

Nutshell: if anyone over 18 wants to have sex with anyone else over 18 in the US, it's legal, whether they're both 30 or one is 18 and one is 78.

I do believe the AOC here in France is 15yrs. As someone who lived through 21ys being the age of concent I do find that too young.

Obviously no teenager is not going to have sex because he is too young. The laws are rather to prevent him from being abused than preventing him from doing something to which he is a willing (and eager) participant.
