Breaking: Antonin Scalia has Died.

He will certainly be remembered as one of the worst judges appointed to the court.

He has helped do more damage than almost any other judge except Clarence Thomas....who can go any day now as well.

The GOP is going to be so focussed on preventing this because they think that they will win the White House..........Dear God...imagine who Trump would put forward.
 
Well of course Obama can appoint a new judge but of course creepy Cruz has already said he will block any appointment Obama puts forward---they will do whatever it takes to stop any Obama appointment and they can succeed they have the votes---there are 3 other 80 somethings on the court---four potential appointments that Pres Trump can appoint---if we don't start getting behind Hillary and stop bashing her because Sanders is never going to elected.

Had this happened two years ago, Obama could have flipped the court.

The Senate is now firmly Republican. There is a chance they won't even hold hearings until the election.

Unfortunate, given nominations were not considered partisan affairs until recently.

It is especially bad timing given that spring is the busiest time for the court; the most weighty decisions are typically issues in June. Now the court is even numbered, which means that ties will result in losses for appellants.

This election has really always been about the Supreme Court......the next president could be in the White House for eight years, so they were always going to be re-shaping the court. And whoever re-shapes the court actually sets the course for the the nation for the next 25 years.

God save us from more white Catholic religious conservatives or Uncle Thomas's.
 
There is already speculation that Obama may nominate Sri Srinivasan. But expect the Senate to put up a battle royal to try to block any appointment (regardless of who it may be) before the November elections.

Yeah maybe some of the day dreamers for a socialist utopia will realize what we are up against in this country---if the republicans block Obama for 10 plus months so they can get elected and appoint a replacement---it would be from what I understand a first --to block a president for that long---but it's what they been doing to Obama for years. They will def try to block this.
As a Italian American this guy was an embarrassment to me although there are some like him in my family---Alito in some ways is worse in my opinion---but this is what we will get if the gop blocks Obama---and President Trump or Cruz get elected because the Dems are fighting with each other.

The passing of this firebrand will change the tone of the court for good, no matter who replaces him.
 
Longest time from nomination of a Supreme Court judge to his appointment in history was Louis Brandeis, nominated in 1916 by Woodrow Wilson.

That took 125 days. Obama has 324 days left in office.

Brandeis was opposed largely because he was Jewish (he was the first Jew appointed to the Supreme Court). He was eventually confirmed on a 47-22 vote of the Senate, with 21 of the 22 votes against him by Republicans.

If the GOP blocks any attempt of Obama's nominations, couldn't he just wait the lame duck session, past November and choose whomever he'd fancy ? (and nominates himself :p )

Assuming the GOP keeps the Senate in November. The confirmation may take place then anyway.
 
This is a surprise. One of the architects of citizens united is dead?

This will actually cause a great deal of panic among the GOP and special interest groups who no longer have the 5th vote to break close ties.

Democrats will benefit from this if they dont play it politically. This will certainly play into voters fears of another conservative court now that the GOP has no leverage to shut down government to prevent a vote on his replacement.

A legal scholar from Yale just said the US Supreme Court has been a majority of Republican appointees since 1972. Scalia isn't the only old one---3 or 4 more openings may happen---the next president---IF IT IS A DEMOCRAT---could change the face of the court for the first time since 1972.
