CA Prop 8 - news and alerts [updated & merged]

Prop 8's passage was more a generational matter than a racial one. If nobody over the age of 65 had voted, Prop 8 would have failed by a point or two. It appears that the generational splits may be larger within minority communities than among whites

The good news for supporters of marriage equity is that -- and there's no polite way to put this -- the older voters aren't going to be around for all that much longer, and they'll gradually be cycled out and replaced by younger voters who grew up in a more tolerant era. Everyone knew going in that Prop 8 was going to be a photo finish -- California might be just progressive enough and 2008 might be just soon enough for the voters to affirm marriage equity. Or, it might fall just short, which is what happened. But two or four or six or eight years from now, it will get across the finish line.

LDS Church didn't report Prop 8 aid, group says

Karger said by phone from Los Angeles that he and others had been monitoring contributions to support this campaign since July 1. He alleges that their research shows 59,000 Mormon families ponied up more than $22 million to the cause, amounting to 77 percent of funds raised.
"I know what things cost," said Karger, a retired political consultant with nearly 30 years experience. "I'm convinced huge expenditures were made that, for whatever reason, went unreported - which is not in keeping with California law."

Stuart Gaffney, a plaintiff in the case that led to the state Supreme Court's May ruling, says the proposition was immoral, and plans to rally in San Francisco on Saturday. "The rights of a minority shouldn't be taken away by a popular vote," he says.
Bryant Tan, 28, a San Francisco philanthropist, attended a few No on 8 fundraisers before the election but wasn't very active. When he learned about the protests through Facebook after the measure passed, he decided to join. "I've seen so many people — gay, straight … people of all kinds of backgrounds — really get activated" by its passage, he says.

I'm hearing reports that 8% of the 53% who voted FOR Prop 8 would now vote against it. That vote switch would be enough to defeat Prop 8 if the vote were held today.

However, the report doesn't say what percentage of NO voters have switched the other direction, which could wipe out some of the switchers-from-YES.

I have no specific source for this, but I heard it on MSNBC.

Why can't California cross religion? They are a pretty progressive state (well, with the exception of Prop. 8).

Gloria Allred is indeed a huge media whore, but if she is willing to help our cause more power to her!!!

a little update...

Today Attorney General Jerry Brown filed his brief with the California Supreme Court arguing that Proposition 8 should be invalidated. His position demonstrates that he is a leader of courage and conviction.

We are very pleased that upon review of the law, he has moved from his previous statements that he would defend Prop 8.

As the state's highest attorney, Jerry Brown has done his job today to defend the Constitution and protect the rights of minority groups, including the more than 18,000 same-sex couples who married in California .
In solidarity,

Thanks for keeping us updated Metta.

Do guys and gals have your white knots ready for inauguration day?

The CA Supreme Crt will hear oral argument on Thursday, March 5, 2009, at 9:00 a.m., in San Francisco in the case of STRAUSS v. HORTON case no. S168047.

The issues are (1) whether proposition 8 invalid because it constitutes a revision of, rather than an amendment to, the California Constitution? (See Cal. Const., art. XVIII, sections 1-4.) (2) whether Proposition 8 violates the separation of powers doctrine under the California Constitution? (3) If Proposition 8 is not unconstitutional, what is its effect, if any, on the marriages of same-sex couples performed before the adoption of Proposition 8?

The other cases are being heard as well. Gloria Allred is the atty for the petitioner in TYLER v. STATE OF CALIFORNIA. Woot woot!! I think she's amazing.
