I'm sure it's been discussed here before, but it's kinda bothering me and I want to talk about it so here goes:

I have this friend who was telling me about his past "gay" experiences.

He says the first experience he had was with a guy who purposely got him really drunk and waited until he passed out. When he woke up, the guy was sucking his dick.

I told him he was basically raped. He said no at first, but now I think he pretty much agrees.

I'd say it is to an extent. Someone could easily call the cops and have someone arrested for it for sure. One of my friends told me he was at this party and passed out totally fucked up drunk at this party, I have seen him this way, and he is cold to the world, and nothing wakes him up at that point. He said he woke up the next morning a little confused, and he said he was wearing a pair of his friends shorts, which he didn't know how they got on. It depends on where you are, and what the law is exactly but it sounds more like sexual assault than rape... certainly that's what the guy sucking would argue!!

In either case, I do agree with you, regardless of expectation, hope, or fantasy, it is never right to take advantage of someone like that. Your friend was not in a position in which he could have offered consent.

As an aside, I had read about this one case of a woman who was convicted of "sperm theft" cos she got a guy drunk, and either sucked or jerked him off and sought to impregnate herself with his sperm. *shudder*
 
Yes, I see it as rape. Even if it was someone I liked, if they were capable of doing something like that to me I don't think I would like them anymore.
 
Personally, I feel that was rape, but it was definitely a sexual assault. In all or almost all jurisdictions in the States, rape requires penetration of the victim.

It was sexual assault unless your friend woke up and let the guy keep sucking him. If he protested that is one thing. If he continued to let it happen, then I think it would be consent.

When I read that definition it basically says that if you are married to the person, then intercourse without consent is okay! That is barbaric. Literally the product of a raving dark-ages theocrat in a tent in Afghanistan. Actually Afghanistan is better than that. We (Canada and other civilised countries) basically ordered them to change a proposed law that would have allowed a man to rape his wife. So they changed it and slid it through over the last week. Now in Afghanistan, the man may not sleep with her without consent, but he can starve her until she consents.

In Canada that is not the case. No consent = rape / sexual assault. (The legal term is "sexual assault" but otherwise the same thing). And the victim in the first post was a victim of sexual assault / rape.

No, as long as he did not catch an STD from it. When a STD is transmitted, I see it as rape, even with consent, as everybody has the duty to control himself regularly when having sex and to only have sex when he is sure he cann't transmit any disease.

OK the first one is def sexual assault. If I woke up and it was a friend or someone I liked or thought was hot, I'd let him keep going and there would be no problem. If I had a party and I woke up with some marine I didn't know was sucking my dick because he was curious, I'd have a new best friend. However that I think this is sexual assault, I believe him not being conscious is also another form of without consent so it could be called rape, however the guy who was non conscious, wasn't being penatrated so I would just say it is sexual assault, especially since he drank the alcohol on his own. I believe this is bs, receiving an STD from having sex with someone while it was consented does not consider rape. It is both persons fault for not practicing safe sex, but of course it is mostly the person with the STD's fault as they are expected and supposed to tell their partner that they have an STD.

22.011. SEXUAL ASSAULT. Assuming this incident took place in Texas, your friend was sexually assaulted under state law.

My friend is "over it" I guess, he just told me about it since we were getting into a relationship with each other and we were sharing some experiences.

He said that was his first ever sexual experience with a guy and it kind of left him not knowing what to think. Since then he had one other experience with a guy, also not very pleasant. I met him as friends and we progressed from there.
