Word is that President Obama will announce tomorrow morning that he is nominating Elena Kagan to be the next justice on the Supreme Court.

Good pick imo. She is relatively young (so she will be on the court for a while) and she has a positive history on gay rights cases.

The biggest issue will be her lack of judicial experience, as well as some incidents while she was dean of harvard law.

Barring something major, however, I don't see anyone putting up a big fight against her.

Most news sites are referring to Elena Kagan as "the never married Elena Kagan".

She is also against DADT

Seeing the policy discriminatory against gays and lesbians, she once called it "a moral injustice of the first order."

When I first saw her, I thought it was a middle aged man in drag..

It seems like Obama is taking the easy way out ...AGAIN..

She has no judicial record..We keep hearing about her ''judicial philosophy." I wish Obama would just grab his balls and take a stand against the right wing already..

Bush never seemed to have a problem nominating right wing extremists,yet President Obama is real wishy washy about putting someone in there to balance them out..

I want a left wing extremist.I'll have to read up more about her, but so far, she doesn't seem left enough for me.She seems a little too cozy with right wingers for me..

From what I've heard, what you advocate is specifically what Obama is trying not to do, because having a more liberal consensus builder is more advantageous than fueling a left-right split.

I'm willing to give him the benefit of the doubt on this case, though in general I think he tries for too much consensus building with a group that refuses to participate.

Yeah,but you said it yourself,how can you build concensus with a group that refuses to participate?

I keep scratching my head, wondering why he keeps trying to include the right in any debate.Time after time, they show up,listen to what he has to say,throw in some wild slurs, then ALL vote against whatever he is advocating..

The time has come to quit playing games with these people.Put in a hard line liberal who WILL stand up to their excesses..

While I don't want to be in a position of defending the strategy, I would say I'm not entirely convinced that the justices can't be cajoled. They aren't going to run for re-election and so don't have a "base" to appease.

The time has come to quit playing games with these people.Put in a hard line liberal who WILL stand up to their excesses.

I think the point is that in a losing 5-4 setting, being dogged opposition still leaves you with 5-4, whereas someone who can engage and cajole may be able to flip a vote and get a 4-5 outcome in your own favor.

I'm not too worried because I don't see Kagen probably voting very differently than Stevens in most cases.

The real opportunity will if one of the far right justices croaks.

Speaking strictly as a gay man, the more chunky single gals on the court the better.

(And though I was a Hillary supporter in the primary, neither I nor any others I knew thought Obama was a "woman hater".)

Bush never nominated a right wing extremist, he nominated well qualified legal scholars and judges, including blacks and Hispanics, who were nakedly blocked and filibustered by Democrats in the Senate. Something the Republicans didn't do to Bill Clinton.
 
You guys have settled my fears. I seem to have hearing all morning things about her that sounded like she may be on the side of conservatives. I hadn't read anything about her gay issues. I got some studding to do.

Justice Kennedy has been a swing vote, siding with the liberals on a number of issues, such as abortion and civil rights.

And Timm, Bush appointed right-wing, result oriented judicial activists.
