So, you think the employer's rights trump the employee's human rights.

Do you think it would be okay for employers to rape their employees? If not, why not? Why should the employee's rights be superior to those of the employer?

Do you think it would be okay for employers to murder their employees? If not, why not? Why should the employee's right to life trump the right of a rich person to kill someone he doesn't like?

Ben, you don't seem to understand the concept that human beings have rights, merely by virtue of the fact that they are human. These rights are not dependent upon how much property the human being in question may or may not possess.
Historically, under the common law, employment was at will. Either could refuse the employment relation and either could legally terminate the employment. They had equal rights. Gays now want rights superior to employers. Perhaps someday laws wil create those superior laws. But at this time they exist only in some states and in your imagination. The rights do not exist until laws create them.
Democrats in Congress and some states have deprived employers of the right to hire the most qualified persons, and employers in part because of that burden are eliminating jobs as fast as the can, either by outsourcing or technology.

If you have "history" showing that the founding fathers objected to employers discriminating in hiring, or thought that freedom by employers should be terminated I would love to see it. Those rewriting are those who fantasize that the fathers were as anti business as our liberals are.

Religion or the lack of it should not be a basis for employment....unless of course, you want to be a priest or rabbi or imam. But to work at Hobby Lobby or that chicken chain?

Business people who would deny workers a livelihood based solely on their religious faith or lack of it are usually people who have not or would not have that happen to themselves. If I were an employer I would base employee recruitment and retention on factors other than whether they were gay like me. Hiring or firing workers solely because they take it up the ass or accept Jesus Christ as their personal Saviour is not a sustainable business model.

You are missing the point, Ben. If you are a business open to provide goods and/or services to the public, then you ABSOLUTELY DO NOT have the right to discriminate against anyone based on race, religion, gender, age, sexual orientation or physical disability. The positions you mentioned are not innate and can be easily changed (well, maybe not easily changed when it comes to Republicans :-) )

The tread has been mostly about employment. But notice that atheism is not innate and can be changed. So do you think an employer has the right to refuse to employ a neo nazi, atheist, or KKK member?

As I mentioned, one can not be discriminated against because of religion; and, atheism is legally considered a "religion" in that it is considered as one's non-belief in a omnipotent godling. A new-Nazi and a KKK member would be considered a "political" view point; and no HR person would be willing to get into that can of worms by asking a person's political beliefs.

What present law would make it illegal to ask about atheism (except Madison) neo nazi status, or KKK membership? Whether an HR manager would ask is not the issue. Is there any law now, state or Federal, which defines atheism as a religion? I don't think so and most atheists would deny it.

Civil Rights Act of 1964, you know, that bill you keep bringing up to 'prove' that the modern GOP is the beacon of inclusion and those mean old nasty Democrats are the real racists.
