Ben, you don't seem to understand the concept that human beings have rights, merely by virtue of the fact that they are human. These rights are not dependent upon how much property the human being in question may or may not possess.

Historically, under the common law, employment was at will. Either could refuse the employment relation and either could legally terminate the employment. They had equal rights. Gays now want rights superior to employers. Perhaps someday laws wil create those superior laws. But at this time they exist only in some states and in your imagination. The rights do not exist until laws create them.
Democrats in Congress and some states have deprived employers of the right to hire the most qualified persons, and employers in part because of that burden are eliminating jobs as fast as the can, either by outsourcing or technology.

Your quote from the Declaration of Independance, does not help. It gives no hint that gays or even minorities should have the right to a particular job without discrimination. The founding fathers would have been appalled at the suggestion and would not have approved the document. The same is true of the Constitution itself.

If you have "history" showing that the founding fathers objected to employers discriminating in hiring, or thought that freedom by employers should be terminated I would love to see it. Those rewriting are those who fantasize that the fathers were as anti business as our liberals are.

Ergo.....there is a need to protect atheists from discrimination. In applying for an internship, I was once asked about my religion.
Religion or the lack of it should not be a basis for employment....unless of course, you want to be a priest or rabbi or imam. But to work at Hobby Lobby or that chicken chain?

Business people who would deny workers a livelihood based solely on their religious faith or lack of it are usually people who have not or would not have that happen to themselves. If I were an employer I would base employee recruitment and retention on factors other than whether they were gay like me. Hiring or firing workers solely because they take it up the ass or accept Jesus Christ as their personal Saviour is not a sustainable business model.

Even so, it does not follow that refusal to hire atheists should be illegal. Not every thing not nice should be illegal.
