Obama Shift On Gay Marriage

SHIFT ON GAY MARRIAGE: President Obama has decided that he won’t “defend the constitutionality” of a part of the Defense of Marriage Act that seeks to bar gays from marrying, the Justice Department announced.

The change in the White House’s position means that the administration will no longer argue for that part of the law in two lawsuits filed in the Second Circuit challenging it.

This is a slick maneuver: they reference a body of evidence establishing that gays count as a minority that's discriminated against, which kicks the issue up to a higher standard it has to satisfy. They're basically saying, "If this were an ordinary issue, we'd defend it, but at this higher level, we don't see any way to do so, so we won't."

It's kind of like a D.A. giving a state's opinion on some evidence -- it weighs highly, but isn't necessarily determinative.
 
He made public statements in support of gay marriage back in 1996 for crying out loud... We've known this for a long time.

This does signal a shift though.

Before, he obviously was qualifying his statements on gay marriage to appeal to anti-gay voters.

Does this mean he's judged that there is now more political support to be gained from supporting (or appearing to support) gay marriage than from hedging? If so I really hope that time has come. :D

At least among Democrats I think that concensus has been reached. The Dems who voted no last time in New York should take notice.
