Intentionally spreads HIV and blames victim in court room

A California man accused of deliberately infecting his lover with HIV has been sentenced to six months in prison, but showed no remorse as an angry judge said she wished she could order him to more time behind bars.

Thomas Guerra, 30, blamed the victim, who was not named in court. He had responded to a post from Guerra on the gay dating app Grindr.

"I did not rape this person. I did not take him against his will. Within five minutes of Grindr text-messaging he was there. If you're that reckless with your life, how can you blame anyone else for your actions?" Guerra asked the court Monday

Prosecutors said Guerrra bragged about having unprotected sex knowing he was carrying the virus. Investigators found some 11,000 text messages sent by Guerra. In some of them, he falsely told would-be lovers that he was HIV negative.

Read the disturbing texts in the link. Sucks to be the victim(s) who was sentenced to lifetime of immune system management. A reminder to as all to play it safe with charming boys whether on Grindr or in bars. 1 hour (if even) of fun with a person whose name you won't even remember is not worth the lifetime of diminished quality of life: socially, emotionally, economically, and physically. Wrap it up with that pretty boy who texted you he was "DDF CLEAN."
 
Surely the max sentence for transmitting incurable diseases should be higher.

In his clear insanity, there is a point to be made: protect yourself. Stop expecting others to tell the truth all the time, especially on a fucking hookup app.

I, sadly, think his light sentence was due to his smarmy, yet accurate, words(though I've only read the quote and not the entire article).

This story perfectly underscores my long-time position that your health is your own responsibility. Always protect yourself, never take anyone's word that they're HIV-. Ever. Some guys lie... and some guys just don't know. Their last test came back negative and they don't know they since have been infected. Some just assume that they're HIV- because they're not bottoms or they trusted partners who weren't trust worthy.

Whatever the reason... Your health is your own responsibility. His victims would most likely not been infected had they insisted on using condoms regardless of the "No, seriously dude, I'm HIV-" from him.
 
Even if he did falsely claim that he was HIV- to some people, if you bareback someone that you just met on grindr then the responsibility is at least shared.
 
I think it is totally ethical to strongly condemn him and to criticise his victims for their foolish behaviour whilst sympathising with the situation they are now suffering.

Yes, you ARE defending the guy & blaming the victim.

If a woman gets raped -- is it her fault because she was dressing in revealing clothes, hanging at bars late at night? Wasn't it her responsibility to "protect" herself by not dressing like a prostitute & not going out late at night??

If a gay man gets gay-bashed by bunch of straight guys, wasn't it his responsibility to learn karate or learn how to shoot a gun so he could "protect" himself from his attackers??

The reason liberals play mental gymnastics on this issue is because the perpetrator is also gay. There's no straight man to blame here. The reason the perpetrator received such a short sentence (6 months) is because liberals (esp. the gay community) in the state have pushed for the decriminalization of HIV laws.

Here's the thing: if you knowingly & maliciously spread HIV to other people, you SHOULD be given the same punishment as attempted murder. Because that is what this guy has done to his victims. He has subjected them to a lifetime of expensive medications, side effects, and a shortened life. They will not have the same romantic life, his victims will now have to disclose they have HIV & many people may choose not to date them. He has ruined the quality of their lives, in the same (or worse) way a violent criminal who injures a person does.

I don't think any of us have disagreed with this.

Remarking on the fact that his victims did not take the precaution of using condoms and saying that this is a responsibility that everyone should be aware of does not detract from our condemnation of the guy.

No one is blaming the victims rather emphasising that there was a means by which they could have protected themselves.

By the way your comparison with rape is, in my view, inappropriate. Your comparison with murder is one I would totally agree with.

But yes... I DID kind of blame the victims because they foolishly put their health into the hands of someone else. Like I said... your health is your own responsibility. They allowed someone else to do that.

I never walk into a street without looking to make sure there's no car coming... even if I have a "WALK" sign flashing at me. Because ultimately it's my responsibility to ensure my own safety.

I guess you want to live in a "who pissed in my pants" world where nothing is your own fault and everyone else needs to watch out for you. Sadly, that world doesn't exist.

what a stupid comparison. None of his victims were forced to have sex with him. They chose to have unprotected sex with someone whose status they didn't know.

No he isn't. The sex was consensual,so any suggestion of rape, or attempted comparison, is moot. What we have is the nasty asshole who went around and apparently stated he was negative while looking to hook up. He's guilty of intentionally infecting at least one person, the victim. We all agree on that.

The point many here are making is that the victim isn't completely blameless as far as the infection. HE blindly ran directly to someone who should have been considered a potential output of STDs. HE blindly chose NOT to use protection. With all the news coverage of issues like this it isn't like he didn't know better, he just chose NOT to care until after the fact. If the victim had been raped, or insisted on protection (and it ended being sabotaged by the guy) then yes, the victim could absolve himself of responsibility. But as he willingly went along, knowing the potential risks (or at least not caring about them), well he could have avoided it.

The fact is we are each responsible for our own health and well-being. If we don't care enough to take precautions we can't hold ourselves blameless should something happen. That's like going to the firing range and darting out in front of the shooters and expecting not to end up getting shot. You may get lucky and dodge a bullet or two, but sooner or later its gonna happen.
