(CNN) -- An Iowa district court ruled Thursday that same-sex couples can marry based on the state constitution's guarantee of equal treatment, court documents show.

The ruling was in response to a December 2005 lawsuit brought by six same-sex couples seeking to wed. They were denied marriage licenses and claimed such treatment violates equal-protection and due-process clauses in the Iowa constitution.

The court also struck down a state law declaring valid marriages are only between a man and woman.

The Iowa District Court for Polk County advances the case to the Iowa Supreme Court which will make a final decision on same-sex marriage, according to Lambda Legal, a gay and lesbian legal organization representing the couples.

The 63-page ruling, written by Judge Robert Hanson states: "Couples, such as plaintiffs, who are otherwise qualified to marry one another may not be denied licenses to marry or certificates of marriage or in any other way prevented from entering into a civil marriage pursuant to Iowa Code Chapter 595 by reason of the fact that both persons compromising such a couple are of the same sex."

The law describing marriage as between a man and a woman, "constitutes the most intrusive means by the state to regulate marriage. This statute is an absolute prohibition on the ability of gay and lesbian individuals to marry a person of their choosing," Hanson wrote.

Lambda says the six couples are all in long-term relationship - one couple has been together for six years, another couple has been together for 17 years.

"Three of the couples are raising children, others are planning families, and all want the responsibilities of marriage and the protections only marriage can provide," according to the organization.

"We respectfully disagree with the court's decision, and we're going to ask for a stay," said Polk County Attorney John Sarcone.

He said his office will examine whether it's best to file a motion to reconsider. But barring a change in the court's opinion, Sarcone will appeal the ruling.

Co-counsel for the plaintiffs along with Lambda Legal, Dennis Johnson called the ruling "a significant step forward in recognizing the constitutional rights of all Iowans, and it's an amazing day for same-sex couples and their families all across Iowa."

Am I correct in assuming that same-sex marriages are illegal in the USA or in most of the states. I find this hard to believe as here in South Africa same -sex marriage is legal. These marriages may even be performed in churches.
 
gollum -If you check in with just about any Christian in the US, you'll learn that South Africa is a godless nation which will be smitten with the wrath of God. The only way the US can be saved from a similar fate is to keep gay marriage illegal.

Their legal arguments are two-fold. The first is "because God said so". The second is to point out that homosexuals already have equal protection under the law because gay men are free to marry any woman they wish, and conversely lesbians can marry any available man.

These are the death throes of the discrimination. Both arguments are so ridiculously lame from a legal standpoint that they're losing more power every day. Massachusetts is the only state in the US to fully legalize gay marriage, but a growing number of states are taking steps in that direction.

Have a bit of patience with us -we'll get there, I promise.

Well....Massachusetts has gone as far as they can. Full legalization of gay marriage cannot happen until it is done on the Federal level. Until then, we do not have equality. All this stuff about doing it state by state is just done to slow down the process of full equality.
 
This is good news. I think the courts are the way the marriage battle will be won.

This would be a good organization to support. The next step will be to argue this before the Iowa Supreme Court.
 
slwoly but surely,we are winning this battle. I wish the "Christians" would quit harping about the marriage aspect. All we want is to have the same rights and protections, you can keep your damn religious ceremonies to yourself
 
One step at a time is all it takes. One day, marriage will be an option for most same-sex couples.

So true, & so sad....but I still hold Mass as a candle-in-the-night sort of thing for my desire to be married.

The same thing has happened everywhere that a jurisdiction has tried to accomodate gay marriage, except Massachusetts.

I would suspect, sadly, that Iowa will pass a constitutional amendment banning gay marriage. That is what has happened almost everywhere it seemed a court would permit same-sex marriage.

Hopefully they won't ban civil unions. Iowa has a very strong civil rights tradition.
 
I'm so fed up with political games and people using not giving people equal rights to gain political power. I'm seriously considering writing in Dennis Kucinich for President instead of voting for Hillary. He stands for so many things that I believe in, including equal rights, gay marriage, and universal health care. I realize that he wont win....but I'm really getting sick of politicans sucking up to the religious right and powerful lobby groups.
 
So,,today 20 some couples flocked the the Clerks office ASAP.Filled out their apps.
The first couple had the licenses at 8:15. The Judge waved the mandatory 3 day waiting period. Shortly after 9:00 they were Married,signed the License,and returned to the Clerks Office,and it was filled before 10:00am.

Minutes after a Stay was issued by the Court. and all apps were placed on hold,pending an appeal to the Supreme Court.

SO...the thing is...two guys in that very small window of time did by all legal means and definitions got Married.Before the Courts blocked any legal marriage,they DID IT !!

Now they are a legal couple. If the SCOTSOI rules that the issuing Judge be overruled,are these two guys still legally couple ? Can the S.C. declare the Marriage Null and Void ?

I think they will remain legally married,as it was legal at the time.(that 2 hour +/- time window)

Reading that it was stayed and that it is destined to have a constitutional ban, despite the fact that its expected, literally makes me cry...

Maybe its Radiohead...but...Man that hurts. :/
 
It saddens me that a country like the United States is so far behind....

Already there are at least 5 countries, (Netherlands, Belgium, Spain, Canada, and South Africa) that have legal marriage and not to mention several that allow for civil unions....

Yet the U.S. still refuses this... WHY? Why is gay marriage such a horrible crime that it can't be legal? Why must the love between 2 people be considered such a hazard to anyone else?
