To me, it would have been a deception if the owner drove the rust-bucket to potential clients to provide estimates or to the job, but drove his BMW or new truck the rest of the time. But if a vehicle is only a means of transportation to him, then it is not a deception. My car is 12 years old and friends are after me to buy a new one. However, my drives fine, rides fine, and gets me where I need to go.
