OK, yeah, cigarette compliance is a huge friggin' deal - I get it. And violations that are proven call for immediate firing with a non-rehire status - she can never ever work for this company ever again. I get that, too - Honey, you screwed up way badly and we need to talk about this. But in this particular case, couldn't you have at lease waited until the poor woman came back from foot surgery, and came back off of medical leave? Couldn't you have waited until then to fire up the gallows? There was a humane way - a decent way - to go about firing this woman. And this was not it. Not at all. This was a very big thing done very, very badly. I, for one, am ashamed. Straight up ashamed.
If the foot thing was work related, your company would get a huge ding on their insurance record for a time loss work accident - at least if it was in my state. Your company would need to pay her to NOT work for a very long time. Where I work, time loss accidents are huge, and something we try VERY hard to avoid, even if it means the employee just sits there and organizes papers.
