Lockdown at the US Capitol

Good. But the scope of future cases has to start covering those who planned and arranged it. Foot soldier convictions good... now move to Trump and all those who were behind the sedition.
I want to see some members of the House escorted out in cuffs.
Or if the House facilities serve as "sanctuary" for them, see them having to live in their offices....

Are Americans so jaded that this hardly rates a mention now? It is like everyone has moved on.

Former Vice President Mike Pence was issued a subpoena by the special counsel investigating ex-President Donald Trump for his efforts to overturn his 2020 election loss and events leading to the Jan. 6 Capitol riot, NBC News confirmed Thursday evening.

People will pay attention when he shows up to testify - which won't be happening anytime soon. Now come the appeals, the specious claims of privilege, and the inevitable accusations of political prosecutions.

Things would move much faster if Pence didn't have things to hide. They are all guilty, and they all are going to refuse to cooperate.

No question.

Even glaciers move way faster these days than this process will.

So a question...is the delay in charging Trump possibly a ploy to let him wreck the GQP in the run-up to 2024?

Here's the deal: You can only use executive privilege to refuse to answer a specific question. That means you have to show up, you have to put your butt in the seat and hear the question. Pence received a subpoena and his lawyers are earning their fees, they are negotiating the terms of his appearance to avoid the risk of being compelled to testify.

Executive privilege is not in the Constitution. If these bozos want to continue with Federal Court cases, they're going to run up against a recent direction from SCOTUS that tells the lower Federal Courts that unless something is in the Constitution, it is not a right ("Originalism" - the poetic justice of the 3 Originalists that Trump put on SCOTUS). They run the risk of eliminating ALL rights to claim executive privilege if they go down that road.

I suspect that for Pence it's the desire to maintain all possible viability as a future Republican Presidential candidate, and he'll have even less viability than he has now (which is saying something) if the Trumpkins see him as a snitch.

Mike Pence has long been said to hold a sincere belief that God wants him to be President.

The sad, and stupid, thing is that God presented him the opportunity to be president on a friggin' silver platter, starting on January 7, 2021.

If he had rounded up enough Cabinet members to invoke the 25th Amendment, he might have been President for only two weeks, but he would go down in history (despite his countless flaws) as The Man Who Saved American Democracy.

(Not incidentally, it would also have sent a message to the right in this country that some things really are beyond the pale. And if those in power don't send signals like that, people conclude that things like the insurrection really aren't beyond the pale, because nobody, or only the little people, got punished for them.)

And, of course, if Mike Pence had become The Man Who Saved American Democracy, he'd be in a far better position to become President than the next-to-zero-chance position he's in now.

The toad has already said he's using executive privilege. That will have to be litigated, the subpoena will nt be enforced until that's done, then that will get appealed. Whether or not privilege actually exists will depend entirely on which way the SC jumps. That's not a gurantee for the toad, but it remains that the assholes on the Court are legislating from the bench and already proved they could give a good goddamn about the Constitution or any inconvenient precedent.

That's why there's a rapist and two Christoban terrorists on the Court with Uncle Thomas.

I dare to hope there is some Machiavellian strategy, but I suspect not.

I doubt that even Miss Lindsey could have stomached Lurch on the throne, and we all know what a slut she is.

Pence tried to find a way to give the toad what he wanted. He knew it was illegal and, in the end, jumped the other way, no doubt partly because he wanted to be President. The grand Irony is that we have Dan Quayle to thank for that. The smaller irony is that lurch's great moment of courage was just lacking the balls to break the rules.

But he was in on it from the start - the entire West Wing was. The only ones who get a pass are the ones that left, and even they didn't step forward and rat out the traitors.

The only person on Earth who thinks Lurch has a snowball's chance in hell is Lurch himself. The trog horde was trying to hang him for fuck's sake. He may have conveniently forgotten that, but they haven't.

Hopefully they still have their tumbrels ready and waiting for him.

And we have our answer... the Pencebot is not going to use "executive privilege" because his attorneys probably know they won't win that one. Instead, he's going the "Originalist" approach: "I was the President of the Senate".

Former Vice President Mike Pence is expected to fight a recent subpoena from the special counsel investigating former President Donald Trump’s post-2020 election activities based on the grounds that he was president of the Senate at the time and therefore shielded from the order, sources familiar with the matter tell CNN...

Pence is expected to make arguments raising the Constitution’s Speech or Debate Clause, according to a source. The clause protects legislators from certain law enforcement actions if the conduct in question is related to their legislative duties. Lawmakers have tried to use the Speech or Debate Clause to resist participating in the House investigation into the January 6, 2021, insurrection at the US Capitol. Sen. Lindsey Graham also invoked the clause to challenge a subpoena in the Fulton County, Atlanta, investigation into 2020 election meddling, but the South Carolina Republican was ultimately ordered by courts to appear for testimony in that probe.

Nice gambit there Pence.

We will now find out if the US constitution allows the Executive Branch total immunity from the laws of the land.

Stall tactic, they're going to go through every ridiculous argument one after another. His attorneys know this isn't any less ridiculous than toad claiming executive privilege. They're going to keep throwing crap at the court until some judge puts a stop to it.

The strategy of endless litigation is why it seems that they never have to answer for anything. If you can pay for it, you can delay and delay and delay........

Plus the court can procedurally delay if you're in the right court. A few judges though are starting to sanction lawyers so there's still some hope.
