It wasn't his intent to kill the child, which is why there is no 'murder' charge. Since the child died as a direct result of his actions, 'manslaughter' is the only charge available. If evidence arises to indicate that the man intended to kill the boy, then the charge can be amended to 'murder'.

It's the same as a drunk driver who smashed his car into someone else and people die as a result. It wasn't his intent to cause the accident, yet the people died as a direct result of his actions. 'Manslaughter' is the only charge available.

These are the kinds of families (I use that term loosely) where lots of them witness abuse on a regular basis and do nothing. Then when it ends like this one did, they want to pretend they are innocent victims. The only innocent one here was the little boy. It breaks my heart.
 
I think I'm with Sixthson on this: The killer lived with the mother of the murdered (It is unreasonable to imagine that a child of ten years, let alone 17 months could possibly endure being choked and pummeled with closed fists by a man the size of this arse-wipe. Also, there seems to be an implied delay in calling the emergency number.) baby and there is no way that signs of his violent nature would have been hidden from her in all of that closeness and intimacy. She is meant to protect her child including from men she's hot for or fed by.

The death penalty is fraught, but I would hope that the man lives a miserable life in prison for a long, long time. That poor baby, suffering such a dreadfully drawn out death, deserves justice coloured with retribution. :(

To continue my explanation a bit more, it is much easier to convict a manslaughter charge since all that has to be proved it that the child died as a result of the beating. Were he to be charged with murder, the prosecution would have to prove beyond a reasonable doubt that the man intended to kill the child.

In our eyes, it was murder. In the eyes of the law, it wasn't. There must be that distinction. The child is dead and the man is responsible. Manslaughter will put him in prison. Murder would very likely let him walk.
