Ooops! I dropped my granddaughter to her death off the ship. It can't be my fault -- I only held her up to the open window that she couldn't reach.

The facts are not in dispute. The grandfather admits doing what he did. It's just that he blames the scenario on the cruise management. He states, via his lawyer, that the window should not have been open and that the ship provided too little safe space to play for children.

Of course the window was open. She didn't fall through glass. And he lifted her up to it, by his own admission.

Butterfingers is not a big deal when someone drops a plate or item. It's a serious flaw when dropping children. He's suffered terribly, but it's his to bear, not the cruise line's.

The fact that he his holding her above his shoulders implies something other than he has stated. If he were only holding her up to bang on the glass (God help us all), when why so high up. The entire wall in front of him is glass. She can see just fine if he only held her up to carry her on his chest, or shoulders. Instead, it appears as if she is indeed reaching to see or play at the open window above. It seems even more ludicrous for anyone to hold a child up so high with so little control at that height. It appears to be an even greater factor in the disaster that ensued.

Frankly, it simply looks Darwinian. That doesn't make it less horrible.
 
Well, I have to eat my words. The facts are indeed in dispute.

The grandfather claimed he didn't know the window was open. The video shows that he held the child in place for a significant length of time with her outside the window, so he absolutely did know.

In this case, the Puerto Rican authorities appear to be prudent, and the carelessness of the act in Puerto Rican territorial waters means child endangerment is a legitimate prosecution.

It's all well and good to treat tropical countries like banana republics, but they have their own justice systems and expectations of conduct. It's their call to make.
 
The original objection is reasserted. The folly of the act is regrettable. Anyone foolish enough to kill one's grandchild by carelessness is to be pitied. Anyone who lies about the deed in a denial is not to be empathized with. It was a terrible accident, but entirely his fault.
 
The chief victim in this case is the deceased and her family. Proper sympathy belongs with them.

But, the responsibility lies with the grandfather, sadly.

It does not belong with the cruise lines.

And there ought not be any further repercussions for them, the managers, owners, architects, agents and attendants whose lives were also impacted by the grandfather's regrettable stupidity.
 
The family's lawyers are dogged. Still claiming no windows should be open. I don't think people pay those prices for cruises to be closed in. The fact that no children have fallen out of the millions before suggests the windows are safe enough.

We don't need a world with a safety warning on every window. God help us.

And I hate living in a world where people are suing each other instead of taking responsibility for themselves. This family ought to know better than to sue. And the grandfather ought to know better and take responsibility for this. When we go anywhere, I always keep a lookout for my nieces and nephews even though they are teenagers. Never would have any responsible adult put a toddler or baby near an open window.
 
There are a lot of people involved.

Right off the top, a ship load of tourists who had their trip interrupted, perhaps completely spoilt. Refunds? Who will pay?

Some of these people, particularly those who witnessed the landing and/or the cleanup, will likely make medical/phycological damage claims. Who will pay?

It's quite likely that the courts will be trying to sort all of this out for years.

They'll have to prove that the death was someone else's fault if they are to collect on it.
 
/\ Yeah, that's what I hear. I don't dare watch any such videos because I find stupid people doing stupid shit funny as hell and that always gets me on someone's shit-list.

Anyway, there are many insurance companies involved in this case. A lot of avenues for them to pursue - if they're hunting for gold.
 
I'm more inclined to think these are typical parents who can't possibly take the blame/responsibility ----- just as this thread's title/author began.

Looking for anyone else to blame so they can dodge/hide their own incompetence.
 
I can't read the link, did they find her body, did she wash up on the shore somewhere ?
 







That's a relief, well compared to losing her at sea.
