This is insane. Native Americans were granted citizenship in 1924. The 14th amendment phrase "and subject to jurisdiction thereof" referred to two groups in 1868 when it was ratified.

1) It's true. In 1868, Native Americans who lived on reservations within U.S. borders were subject to their own tribal law and were therefore not subject to the jurisdiction of U.S. law. However, this was remedied by the 1924 law. Does Trump seriously think he can repeal this law?

2) Official emissaries, diplomats, ambassadors etc. of foreign nations - it's the diplomatic immunity thing. A child, born of one of those foreign dignitaries, is not automatically a citizen. That's still in effect.

Any person crossing a U.S. border legally or illegally, or born within U.S. borders, is subject to the jurisdiction of U.S. law thereof.
If they cross illegally, the fact that they are "subject to the jurisdiction thereof" is the thing that makes them illegal in the first place.
