will make a plea to the judge based on his age and any existing medical conditions.

Well judging by the amount of shit you spew, my opinion is that your anus gets used very rarely, for anything.

As for my guess of 8 years, lets wait and see shall we? Even if the prosecuting counsel has her wish for a longer sentence, at his age of 84, i very much doubt him still being imprisoned in ten years time. Even my estimate of 8 years may see him die whilst imprisoned.

^Well Pat, my guesstimate was not far off, though it looks like The Crown may appeal for an extended sentence. The youngest that he can be released at, will be when he is 87 years old.
If he manages to stay alive until he reaches that age. I somehow doubt it.
 
^Well its the insanity that you have to be sentenced by the laws at the time the crime was committed, so if he had committed them more recently I am sure he would have got more. I am sure he will be out in a year or two on appeal, but he won't be heard of ever again.

You raise some very valid points, though anyone sentenced to over 4 years is classed as a long term prisoner, and as such they must serve at least 2/3 of their sentence. Anyone sentenced to under 4 years, has the automatic right to appeal for parole after serving half their term. Unless stated otherwise by the Judge hearing the trial. Also to be considered for an early release, he has to show remorse, and admit guilt. Which i cannot see him doing, after the amount of very public denial he has always maintained.
 
You would get more for carrying a knife he won't show any remorse because he doesn't feel any.
 
He will have been advised to appear suitable remorseful. His wife is also ill - so that will give him reason to at least act as such.

My guess is they will be denied, mainly for "political" reasons, as the notoriety of this case, and the prisoners close friendship with Saville. All goes against him, it also seems that they are now investigating yet more allegations made against him.
At 84 his life expectancy will be cut, because of the massive physiological and psychological effects this would have taking from him.
If he does get an early release, it will only be through a soul and conscience letter from at least 3 Dr's stating his life is nearing it's natural end. Something akin to the release of the Kray twin and Myra Hindley, who were released into NHS hospital care. They both died within weeks of their release.

Yes, documentary evidence is evidence in the form of documents i.e. photographs, tape recordings, films, and printed emails.

It gets messy when people rely on memory— especially if they are people who are brainwashed in religious cults or if they are teenagers with half-formed brains.

For instance, a judge in Baltimore dismissed a lawsuit in 1995 brought by two former students against a Roman Catholic priest who allegedly molested them almost 25 years ago when they were in high school. They claimed that they developed "amnesiac aspect of post-traumatic stress disorder" from the early 1970's until a few years ago. The judge said that the plaintiffs didn't demonstrate that PTSD "automatically leads one to amnesia. This is a leap of faith this court cannot make...The court in no way is judging [the women's] credibility, but their recollection. That did not meet the test of scientific reliability...No empirical studies verify the existence of repressed memory...There is no way to test the validity of these memories."

The Maryland Court of Appeals in 96, refused to recognize "repressed memories" as a basis for postponing the filing deadline, noting that "studies purporting to validate repression theory are justly criticized as unscientific, unrepresentative and biased." In their decision, Judge Robert L. Karwacki stated "We are unconvinced that repression exists as a phenomenon separate and apart from the normal process of forgetting,".

The California Superior Court in 1995 excluded repressed memory testimony. He found that "the phenomenon of 'memory repressions' is not generally accepted as valid and reliable by a respectable majority of the pertinent scientific community and that the techniques and procedures utilized in the retrieval process have not gained general acceptance in the field of psychology or psychiatry."

The Texas Supreme Court in 96 handed down a decision which disallowed evidence derived from recovered memory therapy:
"In sum, the literature on repression and recovered memory syndrome establishes that fundamental theoretical and practical issues remain to be resolved. These issues include the extent to which experimental psychological theories of amnesia apply to psychotherapy, the effect of repression on memory, the effect of screening devices in recall, the effect of suggestibility, the difference between forensic and therapeutic truth, and the extent to which memory restoration techniques lead to credible memories or confabulations. Opinions in this area simply cannot meet the 'objective verifiability' element for extending the discovery rule."


The prosecutor in this case had one strong piece of evidence in the self-incriminating letter and the TV footage from the game show called 'Star Games' being filmed in Cambridge in 1978.
