Harborview is a public hospital in Seattle and similar issues have been raised by staff there, with the goal to invite public input.
 
I've been following this case in the news over the last few weeks. The nurse claims the right to use a women only (by which she means biologically female) changing room and the doctor claims the right as a biological male who self-identifies as female to use the same changing room. The law is not entirely clear and a separate case involving the interpretation of sex and gender is currently being considered by the Supreme Court. Whatever is decided, I imagine a lot of people are going to be unhappy.

The law is actually very clear. Even with Scotland's Self-ID laws you need a GRC to enter single-sex spaces, which he does NOT have.
The policies of NHS Fife break the laws of both Scotland and the UK.

The BBC's reporting on this has been very biased, just like when Mermaids sued the LGB Alliance. The coalition of gays and TERFs ended up winning that case too.
 
How could this shitstorm happen? James Barbour summarises it well, in a single sentence:

And while I hate all religions, I will admit she was never accused of homophobia or any other form of bigotry at work.

Well it's even clearer now. The Supreme Court has determined that a trans woman is not a woman, whether they have a GRC or not. The court has also said that sex is binary which means that, for the purposes of the Equality Act at least, Dr Beth Upton is legally a man.

There are now calls for NHS Fife to stop wasting public money and concede the case.


 
The whole bathroom question seems so unnecessary to me. The premise is the conflation of sex and gender. Bathrooms have always been divided by sex in communal public facilities, going back for centuries and more.

A lot of clamor has been raised about men in women's areas, including implied predatory or even pedophilic intent. Even if the hype is inaccurate, it has created real fear which isn't necessary from the get-go.

The drive seems to for M-T-F transgendered persons to have a gender-affirming bathroom. Well, short of a accommodating owner or builder, that is never likely to happen in over 99% of locations, and justly so due the very low incidence of transgenderism.

That leaves the solution of men continuing us use men's rooms.

The appearance of a feminine gender in a men's room may evoke looks or even comments, but is not likely to result in fear for the CIS men, as only the very few exhibit physical hositilty for drag or trans or gay. And, physical threats remain a crime, prosecutable.

The reverse isn't wholly without issues, as a bearded woman appearing in a woman's room is still a woman, but there will still likely be some outcry even then, although less than a man appearing.

Society has laws and customs that evolve, but nonetheless represent the overwhelming consensus of the population. In the instance of legalization of marijuana, many societies have failed to revise social acceptance or criminal codes, despite widespread minority acceptance. In thte case of transgenderism, an even greater majority is speaking, rejecting the intended changes of the minority.

So much energy is being expended in the fight, but the fight isn't really leading to positive change. That's the reality. We can be sad or glad about that as members of society, but it doesn't change the reality.

Trans men (women with beards) may look convincing in pics and vids with the right editing, lighting, angle and head tilt, but IRL most of us can clock them at first sight, and women do so even quicker than men. So indeed, a trans man appearing in a single-sex safe space for women will not cause the same level of discomfort as a man doing so, even if in his opinion he's done all the work.

Is the "not" a typo?

My assessment of the message being sent by conservatives is "we were asked to be a more tolerant society when LGBTQ acceptance became a movement. Now, you're asking us to replace social norms with the total absence of norms. We reject that."

Essentially, the mishandling by reformers of the trans issue in particular moved an increasingly accepting society from "live and let live" to "live and let die."

Women in a single-sex space for men are a nuisance at worst, but not a danger. One man in a single-sex space for women can be very very dangerous even if the women greatly outnumber him.

The "live and let live" has made way for "all or nothing" it seems. From the article below:

I'm not sure how many bright adults think of trans people as a danger anywhere.

But taboos are ancient.

Men who are not eunuchs have been taboo in places of women's nudity, especially bathrooms. If a trans person doesn't have a penis today, that doesn't lower the fear modern straight men and women have about the vulnerability of CIS women. That trans people are highly unlikely to be any kind of sexual predator is irrelevant, as it is the optics that create the fear or loathing.

Trying to force change and simply dismiss the vast majority of the population as retrograde is how we got to the reactionary laws we now see in America on the subject.

In simple terms, the nation isn't going to overhaul everything in public accommodations in any decade soon just to help a very small percentage feel safe in public bathrooms. Where there are family or non-sexed accommodations, then great, but all the extant facilities won't be retro-labelled to make a virtue signal to reformers.

For those who are trans, I'm sorry public accommodations won't be convenient, but that is the status quo and we are not on a trajectory as a socity for that to change.
