So long as the judge hasn't been removed, even if he's been censured, which is not going to happen anyway, his ruling stands.I think he's already sued the judge (Engoron) trying to try to invalidate the case or delay it. The appeals court hasn't ruled on the suit against Engoron. It's confusing whether Engoron's rulings are valid because of that pending appeal.
One thing that I haven't heard is how NY State handles appeals and how long and how far this will go before its settled.
A lot of people say they are going to appeal, but that is just what it is, it's just asking it's not a guarantee of a reversal, or a new trial, or a trial at all in this case. The only time there is a guaranteed civil appeal is when there is a Constitutional issue on the line. Fraud doesn't count.
Toad has to prove there was something deficient in the ruling to succeed, and this time the burden of proof is on Toad, not the state. That's why appeals rarely get anywhere.
