I think he's already sued the judge (Engoron) trying to try to invalidate the case or delay it. The appeals court hasn't ruled on the suit against Engoron. It's confusing whether Engoron's rulings are valid because of that pending appeal.

One thing that I haven't heard is how NY State handles appeals and how long and how far this will go before its settled.
So long as the judge hasn't been removed, even if he's been censured, which is not going to happen anyway, his ruling stands.

A lot of people say they are going to appeal, but that is just what it is, it's just asking it's not a guarantee of a reversal, or a new trial, or a trial at all in this case. The only time there is a guaranteed civil appeal is when there is a Constitutional issue on the line. Fraud doesn't count.

Toad has to prove there was something deficient in the ruling to succeed, and this time the burden of proof is on Toad, not the state. That's why appeals rarely get anywhere.

To clarify, there are four appeal actions- two have been settled, one has been filed and the other is being threatened.

First Appeal:
In Nov, 2022, Engoron appointed an independent monitor to oversee Trump's businesses. Trump appealed. The Appeals Court rejected the appeal.

Second Appeal:
In Jan, 2023, Engoron held Trump in contempt and fined Trump $110,000 for failing to comply with subpoenas. Trump appealed and he lost 5-0 in the appeals court.

Third Appeal:
Trump's attorneys objected to the 2-Oct-2023 court date. They have sued Engoron to delay and that action is still pending before the Appeals Court.

Fourth Appeal:
After yesterday's granting of relief for the NY State Attorney and findings that the Trump Organization is guilty of fraud, Trump's attorney said they would appeal but it's uncertain whether that appeal has been filed.

And it always works for him until it doesn't and by then, it gets buried.

This time though, so much more may be at stake...although I'll bet that most of their properties have been protected from easy seizure by this time by TrumpCo., knowing that they would be seized and liquidated.

So now it will be years of wrangling over each building and property in NY.
 
Meh, a bunch of the stuff with his name on it, isn't his and never was. I believe he owns the commercial space in Toad Tower, and the penthouse, but that's it, and he hasn't divested of anything that we know of, and now it's too late, the court would block any attempt tp change ownership. As of this point, Toad and its spawn are no longer in control.

No doubt the Saudis will be happy to buy up Bedminster.

I suspect that there are NY construction companies who Trump never paid who would be happy to chisel off the Trump name from the buildings.

It doesn't matter where the property is, if he or Toadco owns it outright, crossing a state line is no protection. The State of FL is still going to enforce a sanction from NY. If his assets are placed under lien, that can be parts or all, if it's all, they are all on the block, including any interests in partnerships and bank accounts, residences, stocks and bonds, right down to his golden toilet.

It's going to depend on what the penalty is, and the lawsuits are going to be coming from people claiming they are not part of the fraud and therefore no subject to sanction - read Ivanka, Barron, the catalog bride, and a host of "partners."

Of course, that won't stop Toad from trying anyway.

The real impact of this isn't going to be on Toad anyway, it's going to scare the shit outta the banks who knowingly play this game with everyone else. Which is actually kinda the point of civil fraud prosecutions.

The other piece of this is the lying on loan applications for the banks. When questioned, one of the lenders, DeutscheBank (of New York) just laughed off the valuations and said they just assumed that Trump over-inflated the value of properties used as proof of financial worthiness.

Were the banks that were foolish enough to underwrite loans operating under NY State charter or Federal charter? The penalties for lying on applications on State vs Federal loan applications come with different penalty. Lying on a loan application in NY State can be linked in with the dissolution of the Trump Organization in NY. Lying on a Federal loan application can get you 30 years in a Federal prison.

Damn this stuff just keeps getting worse by the day. What alternate universe is the Republican Party living in?

Update: Trump is now 0-3

The appeals court has rejected Trump's writ of mandamus request ("Third Appeal" above) to delay his trial. That means the trial to determine the fine will commence on Monday. The State of NY has asked that the Trump Org be assessed a $250 million penalty.

It is ordered that the motion for a stay of trial is denied; the interim relief granted by a Justice of this Court entered on September 14, 2023, is hereby vacated.
