Tellingly, the Appeals Court referred to Trump, the President as 'Officer'...setting up a bit of a question for the SC on Thursday.

...the appeals ruling refers described the president as an “officer.” There is an open legal question – being argued Thursday before the Supreme Court – over whether the presidency is an “office… under the United States” and whether the presidency is an “officer,” as described in the insurrectionist ban.

The appeals ruling said: “It would be a striking paradox if the President, who alone is vested with the constitutional duty to ‘take Care that the Laws be faithfully executed,’ were the sole officer capable of defying those laws with impunity.”

There's some interesting analysis coming out of Trump's FEC filings.

Trump spent $55 million on legal fees. All or most of that money was paid by his "Save America PAC".

Save America PAC appears to be a laundering mechanism for donor money from other sources:
  • The majority ($25 million) of the legal fees laundered through Save America PAC originated from corporate and big money donors who gave money to "MAGA, Inc"* a Trump superPAC. These donors probably thought they were giving to Trump's campaign for President. MAGA, Inc transferred $30 million to Save America PAC, of which $25 million was directed toward Trump's legal fees.
  • Trump still had funds left over from his 2020 campaign fund and $5 million was transferred from the 2020 campaign fund to pay legal fees.
  • Trump's fund raising did jump after his indictments but only for a very short period of time. Overall, Trump's fundraising is down and is substantially less than Biden's totals.

*MAGA, Inc collects 6 figure donations from the ultra-wealthy. Donors include the Mellon family, Linda McMahon (CEO of WWE wrestling and former SBA head during the Trump administration) and Texas evangelical megadonor Tim Dunn. As mentioned in another thread, Tim Dunn is one of the big donors who sent millions of dollars to Austin to help save Ken Paxton from impeachment. He is the same megadonor who met with the Texas Speaker of the House and dictated a wishlist of Dunn's priorities that he wanted the Texas Legislature to accomplish. Also worth mentioning, the Mellon family has been giving millions of dollars to RFK Jr's independent Presidential campaign to keep it going in hopes that it will sabotage Biden's re-election effort.

This is where I think it will land as well.

The SC will torture the text of the 14th to carve out space for the orderly destruction of Article 3 as it applies to Presidents.
 
So Thomas is looking for an out to toss it back to Congress by asking if the article is self-executing.
 
From questions so far...looks like Trump is safe.

Even the lib justices seem to think the 14th doesn't apply in this case.
 
Politico writer thinks that Roberts has likely tipped the hand of the SC on where this will land.

Roberts made plain that he does not buy the conclusion that the 14th Amendment was meant to permit states to determine whether a candidate was an ineligible insurrectionist.

It’s “a position that is at war with the whole thrust of the 14th Amendment,” Roberts said, noting that the position would have empowered the former Confederate states to weigh in on whether a candidate is disqualified from holding federal office.

The 14th amendment was passed to constrain states’ rights and empower the federal government, Roberts said, and is “the last place you’d look for authorization for the states, including Confederate states, to enforce the presidential election process.”
