What is new on the Gay Marriage front?

Interesting, Hawaii has been on the forefront of gay marriage for a long time. They legalized it at one point which was then blamed on 'lying tv ads' and voted down and then civil unions were installed.
 
Indeed,which can be helpful in passing this along. Keep in mind there is a lawsuit pending against the gay marriage ban and even thought it was clear before that civil unions before DOMA were seperate and unequal,since Section 3 has been struck down,it's become even more obvious.
Considering this is a special session,I don't think it would get called unless the votes are there.

The whip count showed 27/16 with 8 undecided in the House and 20/5 in the Senate.
 
If the number stays true,gay marriage will be legal in Hawaii,as 26 is the magic number.

September 30th for Pennsylvania is that for the state or federal case? Also the district court judge in Illinois is supposed to issue a ruling on motions/summary judgment very soon I believe.

Federal.

The ruling on motions in Illinois is due this Friday the 27th. However, it will need to survive appeals if the judge approves summary judgment.

So Illinois may be the next state?

The next four will be in rapid succession in all likelihood making it difficult to predict the order. Illinois will be one of them, but Hawaii is likely to be first around November 2 or 3.

I heard something new on my radio this morning. Somebody in the House that was awake brought up the economic value of equality of marriage. Maybe the invitation from the mayor of Minneapolis had something to do with it. "Come on up to Minneapolis," he said.

An interesting angle: not having equality of marriage might be damaging to Illinois' economy. :eek:

When Minnesota enacted a same-sex marriage law this summer, Minneapolis Mayor R.T. Rybak saw an economic opportunity.
Earlier this month, he flew to Illinois – where legislators had recently failed to pass a same-sex marriage bill – to launch “Marry Me In Minneapolis.” Mayor Rybak invited same-sex couples from Chicago to wed (and spend a few dollars) in his city.

It's my understanding that summary judgments move through the appeals process fast, so depending on the timing New Jersey and Illinois could beat Hawaii.

In the meantime, New Jersey trial courts cannot stay their own summary judgments. So that's something to look forward to.

Republican state legislators, three county clerks, more than a dozen University of New Mexico School of Law professors, the American Civil Liberties Union and other state and national groups weighed in on the last day to file written arguments, giving the state’s five Supreme Court justices plenty to digest before the Oct. 23 hearing.

However, Attorney General Gary King’s office asked the Supreme Court to declare the denial of marriage licenses to same-sex couples as unconstitutional. He says there is no “rational basis” on which to treat same-sex couples differently from straight couples.

Republican Governor Gov. Susana Martinez, hasn't intervened. She wants a vote. Vote for equal rights. Yeah, right.

Yes and no.

New Mexico has never passed partnership rights, but has never banned same sex marriage either.
 
Democrats control the Senate and House in New Mexico and while some of them are opposed to SSM,the last thing they want to do in an off year is increase the number of older voters whom are likely to come out and vote Republican by putting a gay marriage ban on the ballot.

I think our side now has the turnout/enthusiasm advantage, even in an off year election.

Also, it was just announced in South Carolina that briefs are due November 15th.

Democrats are not necessarily liberal, especially away from the Northeast and West Coast, though in New Mexico they are tepidly liberal. If NM had a Democratic governor, there would have been a real chance at passing a same sex marriage law this year.
