What is new on the Gay Marriage front?

There are plenty of initiatives underway. Some to be enthused by and some to be proud of concerning recent efforts.

The military announced not only would they offer same sex partners full marriage benefits but are working on service specific programs so that couples can travel to a state that allows same sex marriage if they live in one that does not.

Additionally, I heard a news report this morning concerning a legally married in Vermont couple who is seeking the constitutional protection embodied in spousal privilege in a murder trial in Kentucky.

Both of those are great steps forward for equality. Recently an Ohio couple was successful in a court decisions to have the death certificate read "married" so that the same sex spouse can be eventually buried in the family cemetery.

Without JockBoy87's constant spurring of these conversation I find they are not occurring. So this is my attempt to get the insight of those of you legal-philes who enjoy this sort of thing.

SO what is happening around you? What do you think will be the issue that drives a Supreme court review of enforcing the states normal policy of recognition of other state laws (including marriage)
 
The California Supreme Court rejected ProtectMarriage's last desperate appeal, finally driving a final stake into the heart of Prop 8. The court said the appeal was a veiled attempt to get the state court to overrule a federal court on a meaningless technicality.

The latest Gallup poll shows record high support for same-sex marriage (54%) and record low opposition (43%), and no backlash following the Supreme Court decisions.
 
I'll have to depend on this site, probably, to hear about any news from my own state of Illinois.
The Illinois House would like to emulate its Federal counterpart --- to do nothing. It can't even approve a state pension bill. The "Equal Marriage" bill was supposed to be passed on Valentine's day. The year was not specified. :mad:

The NJ Supreme Court will likely rule that there is a right to same sex marriage in New Jersey. The state enacted civil unions when the NJ Sup. Ct. ruled that gay couples had to have the same rights as married couples. Now that the federal government will recognize gay marriages in granting federal benefits, but not necessarily civil unions, I don't know how the NJ Sup. Ct. could rule otherwise.

Incidentally, the NJ legislature approved same sex marriage. Unfortunately, Governor Fat Fuck vetoed it, and the legislature does not have the votes to override the veto.

Exactly, but likely/hopefully it will be with summary judgment.
 
There have been Civil Partnerships in the UK for several years, but last month the Marriage (Same Sex Couples) Act 2013 received Royal Assent meaning that gay marriage is now legal in England and Wales. It's expected that the first marriages will take place next summer. Apparently the delay is for general administration (including updating the IT so that it can deal with same sex spouses) and amending the surviving spouse legislation for pensions.
 
I think it is exciting that since the first state legislature heard arguments over same sexes marrying 22 years ago, we can now expect change to come at a relatively quicker pace. I was even heartened by the idea that Ohio could be headed towards a legal showdown for equal rights.

Still i wonder which argument (if any) will push the Supreme court into forcing recognition and thereby forcing same sex marriage on every state.

I imagine it will either be done on 5th amendment grounds or even the 14th amendment
 
I was leaning on the fifth because of the recent story i saw about the lesbian couple in KY. However, that is only because I recently read the story. lol....
 
The DoD announced it will be expanding all marriage benefits to same sex couples by September 1st. The delay is caused by the need to conduct software updates to the DEERS system that is used to track dependent family members and their status to handle same sex couples but all benefits will be retroactive to the date of the Supreme Court ruling.

An interesting benefit to be offered is the option for same sex couples planning to get married but are stationed over 100 miles from any state that authorizes same sex marriage to take a week's leave (10 days for overseas) to travel to a place where they can be married. This caused some discussion at work about appropriateness since there is no similar benefit for opposite sex couples but as I pointed out there no place you can be stationed where you would be more than a 100 miles from a place that will perform an opposite sex wedding.
 
Yeah that is a fantastic perk they are offering along with the benefits. That was what spurred my initial post about the military benefits. I was happy. Funny thing is I am winding down my career so i will narrowly benefit if I choose to marry in the next few years. Yet that also opens the door to a vast array of dependent benefits for when I retire.

This is one aspect that points to a deep thought in enacting the policy for the DoD. I appreciate such considerations. Oddly, I am at a point in my life where I dont know what I would give if I married my beau or if I intend to do so at this point. It is odd to finally have the ability and not necessarily have the desire. Because of my service I will give whomever I marry a lifetime paycheck if they outlive me, and considering my love of younger twinks, it is likely....

The legalisation of gay marriage adds another notch to New Zealand's liberal record. It was the first country in the world to grant women the right to vote in 1893 and it has declared itself to be nuclear-free since 1984.

This could have momentum. A County arguing the constitutionality of the state one man, one women marriage law gaining momentum with two mayors joining the fray has all the correct gravitas to end up in the supreme court, dontcha think?

In western Pennsylvania, Braddock Mayor John Fetterman said he has performed several same-sex marriages at his home. In State College, Mayor Elizabeth Goreham instead hosted a same-sex wedding while inviting a local minister to perform the service.

Indeed. There already is the federal court case pending in Pennsylvania, but this could push the issue to the state supreme court quickly.
 

Indeed,which can be helpful in passing this along. Keep in mind there is a lawsuit pending against the gay marriage ban and even thought it was clear before that civil unions before DOMA were seperate and unequal,since Section 3 has been struck down,it's become even more obvious.
Considering this is a special session,I don't think it would get called unless the votes are there.
