When the Republicans Sweep in November, What is the Future of Gay Rights?

Make that ONE Republican, mister John I-hate-the-Bill-of-Rights McCain.

any one other republican could have broken his filibuster.

the entire republican party holds the shame of that filibuster and DADT is now their mess and responsibility.

It was on the verge of being reversed and they all.. ALL 40 OF THEM... stopped it.

that is institutionalized homophobia in my book and it is repulsive.

It takes one to filibuster.
It takes 40 more to not vote for cloture.

Of course since we get to have procedural filibusters rather than actual... not much difference.

But McCain was the one with the mouth and attitude (and no heart).

Yet somehow there are still those here who insist that there is no discernible difference on the issue of gay rights between Democratic and Republican majority. Yeah right, wishful thinking. Blaming the Democrats for the Republican filibuster is some twisted ass thinking.

I'm going to have to agree with the statement in bold -- because I can't see getting to that statement except by twisted-ass thinking.

Where the frak did you pull that one from?

Nor is McCain the only one to threaten a filibuster.

Okay, I forgot LeMieux.
Nothing like having scrapings from the bottom of a shrimp boat grounded in the tidal flats slipped into my morning coffee.

McCain is an enemy of the Bill of Rights; LeMieux is just a tool. Even tools can be painful in the wrong place.

Excuse me while I go retch.

In the next congress, we can expect no movement on gay rights whatsoever unless the Defense Authorization Act passes with its DADT amendment before the end of this term. If it does, all that's required to repeal it will be certification that repeal will not hurt the military. Congress wouldn't even have to (read: "get to") vote on it again.

No other bills on gay rights stand even the slightest chance of coming to a vote in Congress.

Repealing anti-gay laws--most notably DOMA--will then be in the hands of the courts.

You're absolutely right, and I wish the Supreme Court would just hear them all already and get it over with.

I don't.

Obama has appointed two idiots on top of what Bush did. The only thing I trust the current court on is the Second Amendment, and not very far with that.

Appointments have become so politicized (we know who started that, and BTW it wasn't a Republican), we need a new system.

If it's not the Republicans calling our lifestyle unholy, it will be the Democrats calling it unhealthy (watch for it). Guess which side of that coin has the least resistance in this country today?

The Democrats are using you and they'll turn on you as soon as they don't need you anymore.

Highly doubtful -- sex burns calories, which is good for us. I'd sooner expect gays to be pointed out as a good example of healthy lifestyle; I saw an article about Americans being overweight that mentioned gays as one subpopulation that wasn't with the trend.

The Democrats won't turn on gays if for no other reason than it would be agreeing with Republicans.

Lord! What a bunch of rubbish.

Only because politicians aren't going to do anything unless there's a profit in it. E.T. may be right that they don't really care, but they've built the image of caring, and a good chunk of voters would get pissed if they reversed on that without substantial cause.

1) The Democrats have failed to further major issues in regards to gay rights. With the continued failure to repeal DADT, the passing of ENDA

Don't Ask, Don't Tell will be repealed in the Senate during the "lame duck" session of Congress which has the current numbers and with the support of Snowe and Collins so it will be done. ENDA, on the other hand is a no go for now, but the good news is that states that don't already have them can continue to pass their own non-discrimination laws until such time that it's feasible for ENDA to be taken up again whereas the federal government had to be the one to act on DADT.

That appeal is legally mandated. It is the DOJ's JOB to "defend" all "Current" laws! (Whatever they may be!) #-o

That is a popular myth that is absolutely untrue. The DOJ does not have to defend all laws and can absolutely choose not to appeal. It tends to appeal all circuit/district level decisions to the SCOTUS regardless of whether or not the current administration is in favor of them because it's best to have the US Supreme Court have the last word on things, even if that last word is simply to decline to take the appeal, in which case there is some official endorsement of the circuit court's decision on paper, even if that paper is only one sheet thick. But the DOJ can always decline to appeal any and all decisions, whichever step of the federal court system a decision is at along the pike. They are not "mandated" to appeal anything, legally, constitutionally, or otherwise.

Granted! But ... it is the rule of LAW that the DOJ "defends" the LAW as it Currently stands! Thus, the need for Congressional Revocation! ](*,)

Sorry but you don't seem to know what you're talking about. Just out of curiosity, which law school did you graduate from and what was your final score on the Bar Exam?

There's a good chance that will happen. IIRC, three people didn't vote for it only because they were waiting to let the military finish doing its things. If that comes in before Congress goes home for play time, McCain should be unable to sustain his vile bigoted opposition to life, liberty and the pursuit of happiness, and it will pass and Obama will sign a Christmas present for all who value freedom.

Lord! What a bunch of rubbish.

Rubbish is what will hopefully be on the way out by the end of the day.

I gave these people the benefit of the doubt. I used to be proud to call myself a Democrat. You don't have to like me but you'd better listen. Every Democrat I knew turned on me the instant I criticized Obamacare. And I mean in a nasty way.

The Democratic party is not just gay people. The Democrats are an amalgamation of minorities. That's where they get their muscle. As long as you stay in line and they need you, you're fine. If you become a liability, they'll dump you in a heartbeat.
