You have to wonder if the Kentucky legislature would actually do that. I think our best bet is that she gets taken out of her office in handcuffs, and the people of Rowan County have to elect someone else who will actually do the job.
 
I've heard they aren't going to jail her but fine her for contempt of court. As in fining her $80,000 a day or some other such ridiculous amount(that's her salary btw) that she will be forced to capitulate.

We all knew that Kim Davis has been married four times, but this is some Maury Povich-level fuckery. US News & World Report has the bombshell revelation that she was knocked up with another man’s twins four months before her first divorce. They write:

The Kentucky county clerk facing potentially stiff penalties for refusing to issue same-sex marriage licenses has been married four times, raising questions of hypocrisy and selective application of the Bible to her life. The marriages are documented in court records obtained by U.S. News, which show that Rowan County Clerk Kim Davis divorced three times, first in 1994, then 2006 and again in 2008. She gave birth to twins five months after divorcing her first husband. They were fathered by her third husband but adopted by her second. Davis worked at the clerk’s office at the time of each divorce and has since remarried. Davis has described her desire to strictly adhere to the Bible in stark terms and thus far has shown no sign of bending to court orders on same-sex marriage. She said Tuesday she fears going to hell for violating “a central teaching” of the Bible if she complies with the orders.

Ah, the usual religious-style hypocrisy. But no real surprise. It seems that, like so many of these sort of people, she simply invents her own version of a bible-based morality purely to suit here own biblically-derived prejudices.

I'd rather see her ass get thrown in the jail. If they're just going to fine her... Some bigoted group will set up a fund/campaign to easily earn all the money back to set her free because they support her actions... Which is what really concern me.

Here in the United States, the county clerk's main job is to keep track of all births, deaths, marriages, domestic partnerships, and divorces. Basically, at it's core, it's a public records job. But because it's an official, "trust of the public" job, the people who serve as county clerks must be elected. They do certify and issue every birth certificate, marriage license, and death certificate, and certify all court orders, such as divorce decrees, legal name changes, and such.

But, in many cases, the county clerk's job extends beyond public records. Depending on the state laws or needs of that particular county, the county clerk also...

- processes passport applications
- can function as, basically, the county government's HR department, handling personnel records and the issuing of ID badges for all county employees, etc.
- is in charge of property deeds and mortgage records for every stitch of land and real estate within the county
- handles licensing for business owners and doctors
- oversees any election - federal, state, or local - within the county
- handles all secretarial responsibilities for the district and/or county court system, including the maintaining of court records
- handles all arrest and jail records
- in some counties, can function as the minutes recorder or keeper for all county or city elected official meetings.

In your more rural, small-town counties, county clerks do all this and more. But in the major cities, where the population is so massive that the city or metropolitan area itself is geographically spread across multiple counties...

NYC spreads across New York County (Manhattan), Kings County (Brooklyn), Bronx County (The Bronx), Richmond County (Staten Island), and Queens County (Queens).
Dallas-Fort Worth spreads across Dallas, Tarrant, Denton, Collin, and Rockwall Counties
Atlanta spreads across Fulton, DeKalb, Gwinnett, Cobb, and Clayton Counties, in northern Georgia.
etc.

In those major urban areas where the city's geographic footprint spreads across multiple counties, with each county containing hundreds of thousands if not millions of people apiece, the county clerk's job is basically, birth, death, marriage and divorce records, and the overseeing of elections with the other responsibilities delegated to some other office.
 
I heard a news update on this case a few days ago. The case was sent to the US Supreme Court. Justice Sonia Sotomayor oversees cases from Kentucky. See can handle the case herself or allow the entire court to hear the case.

I suspect the clerk will be ordered to issue marriage licenses or go to jail. She can even be removed from office for failing to perform her duties.
