This has nothing to do with sending them back to prison.

A PO can make something up, write down a report about it, declare the person to be guilty -- and the person is presumed guilty. Someone under the thumb of a PO has the scales reversed: it's guilty unless proven innocent.

My reason for asking is that here in the UK they do not have that sort of autocratic power that is pretty scary. Thanks for putting me right on that one.

The papers that come with having a PO state "and shall obey all orders of the PO". The courts rarely care if the orders have anything at all to do with rehabilitating someone, so long as they don't give the appearance of corruption (like the PO who had his 'clients' mowing his lawn).

And the system assumes that whatever a PO says in court about his 'clients' is true; the burden of proof is on the 'client' to show otherwise. So the slogans for being on probation or parole are "lie to get by", "go along to get along", and "in the face or in the ass?" (fist, or boot, respectively).

Attorneys here tell their clients they're better off to forget probation, unless they want to get accustomed to telling the lies they're ordered to. Here's a real catch-22 I know of: a PO ordered a 'client' to write a statement concerning another 'client' that contained lies. If he wrote it, the PO would in the future deny he ordered any such thing, and the 'client' could be charged with providing false information to the police; if he didn't write it, he'd be refusing a direct order from his PO, and could go to jail for two weeks. And if he tried to fight it, which meant going to court, the PO's word would be assumed to be the truth, and the 'client' would have to prove otherwise!

Presumption of guilt is a powerful tool.

While the invasion of privacy charges are serious, and the kid sounds like he deserves a good-ol-fasioned passionate asswhipping for being a general douche-bag, 10 years in prison is too damned much.

Both of these children's lives are over before they even trully began, and to me it seems like it's just another tragedy added to this whole situation.

While I don't condone Davi's actions; he was a fucking moron not to take the plea like his former GF. With the media out for blood and the courts looking to make an example of the bullies, he should have sensed that this case was gonna turn out bad if he went through with the trial; knowing his culpability.

PS: let's try not to bump year-old threads. I personally don't want to be reminded of BostonPirate either.
 
Wherever Tyler is right now I hope he sees what has happened and knows that there are people who saw the value in his life.

I'm hoping the judge makes it ten years probation. For someone who's never been in jail, that's an incredible punishment by itself.

Judging from how much he posted here, he lacked self control and let it waste his time and life. I never understood why some people feel they are obligated to respond to everyone and everything and always insist on playing last post wins. But that was definitely him.

I agree. Dharun Ravi doesn't need prison - he needs to learn that we're not a bunch of monsters - raving perverts who deserve the kind of mistreatment that he so stridently inflicted on Tyler Clementi. Also, perhaps he might learn that we're not automatically objects of ridicule. He might achieve these goals through court-ordered participation in GLSEN-type meetings. If I may offer a quote from To Kill a Mockingbird: "You never really understand a person until you consider things from his point of view... until you climb into his skin and walk around in it." I don't think Mr. Ravi is even 21. Maybe it's not too late.

IMO this sentence is way over the top

while the guy was certainly mean spirited, this verdict is not a just one

and is extremely harsh

this is a political verdict that does not do the gay community any good at all
 
I agree Ravi should have taken the deal. Not sure that he's definitely getting 10 years in prison. I know that may be the max possibility, but I'm thinking it could be less...? In any case, I feel some punishment is warranted. Not only did he invade Tyler's privacy, but he also tampered with evidence and tried to cover his tracks, etc. He knew what he was doing.
