Walker being gay is about as much an "excuse" as the color of his eyes.

If this was upheld, it would set a very, VERY dangerous precedent, at least in California.

The defendant's attorney could require an appeals Judge to recuse herself, because the defendant is also a woman.

...recuse him/herself, because the defendant assaulted a Republican, and the Judge used to be an attorney for ACLU/liberal causes.

...recuse him/herself, because the defendant and the Judge are both African-American.

OMG! :D That's great news on New York. I hope they take a vote there already.Why's that? I had been expecting it to be settled within the next year considering they only have to rule on the issue of standing. Is it expected to take considerably longer than that?

Well, it might be by then if standing is denied and the case ends.

If standing is granted then it will take longer.

So it really depends on how the standing question comes down.

I'm not that confident that standing is going to be denied.

if prop 8 is deemed unconstitutional, is gay-marriage legal in cali? if not, (as it's not lol, i already know that answer) why not?

i thought prop 8 was in response to cali legalizing gay marriage. /not an american, but still interested in marriage equality news in the states.

Yes, if prop 8 is deemed unconstitutional, as stated by the previous judge, marriage would become legal in California...that is once all the legal proceedings are done.....which will probably include the Federal Supreme Court. So it is going to be a while.

well wait, the judge already ruled that the ruling on prop 8 should stand, and that the judge's sexual orientation doesn't matter. so... shouldn't gay marriage now be legal as of today?

they vowed to appeal the decision, well, ok, but they haven't yet... so what happens for now?

no...they only ruled on the request by Nasty NOM to cancel the original court cases decision based on the judge's sexual orientation. Nasty NOM is now saying that they want to appeal the decision that was made yesterday to not cancel it based on his sexual orientation.

The main current case (not original case) is the appeal of the original judges ruling that prop 8 is unconstitutional. No decision has been made on this.

These are 2 separate issues.

Obviously, Nasty NOM is doing whatever they can to drag this out as long as possible.

When will we get to know the result?

We don't know at this point how the CA supreme court will rule, but from the arguments before the 9th, I got the sense they felt the no standing argument was not that strong.
 
As far as NY - the State Assembly is working on the legislation tonight. Senate won't get to the point of seeing if Republican majority will allow it to come up for a vote before tomorrow or Friday.

Cuomo is pushing hard to get it passed before they adjourn for the Summer.
