Gay Binational Couples to File Lawsuit Challenging DOMA

Consider it the next major court battle against the Defense of Marriage Act: Gay Americans will file the first lawsuit to challenge DOMA on the grounds that it bars them from sponsoring a gay foreign spouse for a visa like straight couples can.

That's a nice angle on it. I suppose a similar one would be to find a couple married in Canada or elsewhere who have moved to the states and their marriage isn't recognized.

BTW, did you notice the nature of that last site you linked to? It verges on Dominionist.

The gay marriage repeal bill has been shelved for this year in NH. GOOD

Support for Gay Marriage Continues to Increase

Pew Center for the People and the Press poll, completed 2/22-3/1/2011. The latest poll shows support at 45% and opposition at 46%, the narrowest margin in the history of Pew polling on the issue. Some polls by other pollsters have found support exceeding opposition but as the chart above shows, the trend estimates have converged by not quite reached equal levels of support and opposition. The consistency of the trends since 2005, however, all but guarantee support will exceed opposition within the year.

A Big Frackin' Deal: For The First Time, More Americans Support Marriage Equality Than Oppose It.

The Colorado civil unions bill passed out of committee 6-3 with one Republican voting in favor. That's big considering it now already has clear bipartisan support, which it will need in the narrowly Republican controlled House. All 20 Democrats in the Senate are signed on as either sponsors or co-sponsors.

Has a Republican controlled legislative chamber ever passed a gay unions bill?

I think this might be a first if it passes.

It should be noted that the lone Republican in the committee who voted in favor of the civil unions bill, Ellen Collins, spoke out in favor of the protections for children in the bill. She talked about her experiences working in family services and how she saw gays/lesbians being just as loving of parents as straight people.

Never. But the NY Senate passed a non-discrimination bill once.

If it comes up for a vote in the CO House it will be a first.

Letter To The Editor

Majority in the wrong

A writer to the Opinion Page recently asserted that Proposition 8 was passed by a "majority of voters" and, therefore, as she says, "lawyers (should not) be able to nullify the vote of the people."

I would urge anyone who holds a similar view to review the history of housing laws in California prior to 1964. Restrictive covenants in property deeds were common and enforced by government, real estate associations and neighborhood associations. These covenants prohibited houses from being sold to, or occupied by, African Americans, Jews, Hispanics, and Asians. In one bizarre case prior to World War II, a black man was told by the courts that he could own a house in a white neighborhood but could not live there!

The Rumford Fair Housing Act passed by the California Legislature in 1960 prohibited such restrictions. Subsequently, the California Real Estate Association qualified an initiative that specifically restored restrictive covenants. The initiative, Proposition 14, was passed by 65 percent of the voters.

Just as with Proposition 8, Proposition 14 was challenged in the courts. In 1964, it was declared unconstitutional because it violated the Equal Protection Clause of the 14th Amendment. The same is true of Prop. 8. The letter writer asks about "states rights." The issue of states' rights was the root cause of a bloody civil war. Had the Union and President Abraham Lincoln not taken a stand on that issue, we would still have slavery.

It is unconstitutional and immoral to discriminate against a group of people because you don't like them.

Firsthand experience usually does the trick. It's amazing how prejudices just melt away, in that way.

That's why the Pink Pistols make a point of inviting local politicians to go shooting with us. The unusual combination of gays and guns intrigues most of them enough that they accept our invitation, and we get to argue gay rights and gun rights at the same time.

Interestingly, the fact that a persecuted minority is relying to an extent on firearms for their protection has more than once tipped a politician to support some of the pro-Second Amendment measures -- just as the fact that there are gays into guns has tipped some toward supporting gay rights.
