Had a tenant that hasn't paid rent for 5 months. I finally filed for eviction. I won the case and judge gave them until tomorrow to leave before I can have a swat team remove them. This morning I got a phone call from one of my people who drove by the place and noticed it's been vacated. So, I went there to check with 2 of my people just in case there's trouble.

  • Every window is broken.
  • Every baseboard heater is broken.
  • Every kitchen cabinet is broken and taken out.
  • Some kind of red jelly thrown all over the place.
  • Holes on walls.
  • Every appliance is missing.
  • Toilet is missing.
  • Concrete poured down the toilet flange and the bathtub.
  • Every ceiling fan is broken.
  • Some wires torn out of walls.
  • Flooring completely destroyed. Heck, they even tore out the linoleum flooring and it's missing...
  • Etc.
You get the idea. Off the top of my head, I'm guessing about $40k worth of damage... probably more.

That's awful. The tenant should be arrested for criminal damage.

Do you have insurance cover for this sort of thing?
 
I would first get a UV light to assess and then a Hazmat suit.

In the end though, it could have been worse.
 
That had to have made a lot of noise for quite a while.

How could neighbours not have heard that going on? Did anyone call the police while it was happening?

I have already filed theft charges against him. There currently is an active warrant for his arrest due to theft charges from his employer... ex-employer I should say. The warrant just got put out this morning.

As far as insurance, I've no idea. I'll contact my agent tomorrow or something to ask about it.

LOL worse? You do realize I will have to dig up under the house to put in new sewer pipes right? Since he poured cement down the pipes.

Funny about this. The house next door is also mine. I own 3 houses in that neighborhood. Anyway, my tenant next door told me they heard noises last nigh5 but didn't think much of it. Apparently, it went on all night.

I think he knew there was gonna be a warrant out for his arrest this morning so he spent all night destroying the place and took off.

Ps - both my guys were armed while we were there. For a moment, I felt like a crime boss... just some fantasy I got haha.

Yes. It could have been worse. I have seen worse.

Just make sure you photograph it all carefully and prepare a report.

And by the way. It isn't legal vandalism.

Hopefully next time you will see the warning signs.
 
All that from just one guy?

I would check in the attic to see if he drilled holes in the roof from the inside.

It is legal vandalism. Why? Because if this was done by someone to someone else's property, then it is vandalism and they would be charged. But since he was a tenant, the worst thing that can happen to him is I get a judgment against him which I will never see a dime of because chances are he's going to jail.
 
Of course it's not legal. If it was, the police and the courts would be unable to do anything about it. In the UK, what happened to your property would be considered "criminal damage". I'm sure there must be similar legislation in the US.

I will consult my lawyer in the morning. But I'm pretty sure the best I could do is get a financial judgment against him, which I will not see a dime of.
 
I am totally amazed! That's deliberate criminal damage. What on Earth did you do to deserve that? Whoever did it deserves more than jail, they shouldn't be breathing.🤬

When he stopped paying rent, he became a trespasser and a squatter, neither of which is legal.
 
Shouldn't you have left everything as you found it? It's a crime scene.

Without proof, fingerprints would be nice, he can just say some crackheads/homeless people/teenagers must have done that.

Oh and, once again, check with the neighbourhood to see if anyone has video. It's amazing what even those little doorbell cams catch these days.

I think others here are right, this must qualify as criminal vandalism or criminal mischief or something. Unfortunately, it will probably be just one more thing on the guy's lengthy rap sheet. Still worth filing charges, and that will probably help with an insurance claim, too.
