Clarification: I didn't realize when I posted earlier in this thread that this is a PRIVATE park. That means there are zero constitutional issues here. The protestors are there at the pleasure of the owners, not because of a right they have.
This is more than likely why they postponed the cleanup.

So I guess this will take JB3 and others out of saying it is not unconstitutional.
It is a private park that the owners are required to leave open to the public 24/7. In New York City, in order to get approval for very large building developments that will have a large impact on the public, developers are required to provide certain amenities, like creating parks on the property or other public space, renovating subway stations and keeping them clean, etc. This is one of those parks. When the developer built the building, a condition of its approval was to create a park that would be open to the public at all times.
Another interesting side note, Mayor Bloomberg's girlfriend is on the Board of Directors of the company that owns the park. Bloomberg is a scumbag.

This AM I logged into Occupy Corpus Christi to see what the status for tomorrows protest. There were 16 members.
This afternoon I went back to see if I had a reply, and now, here are the totals.
174 will attend
134 may attend
2217 waiting for an invite
60 not attending.

This morning, Occupy Wall Street protesters celebrated when New York authorities beat a last-minute retreat from clearing Liberty Plaza – as hundreds of labor and other activists rushed to defend the square.
But at the same time this morning, dozens of state troopers in riot gear cleared out Occupy Denver protests. In cities across the country, Occupy protesters have faced police violence, arrests and forcible removal.
The authorities say we don’t have the proper permits to occupy public spaces. Our permit to occupy is the First Amendment.
