And is there now something about interracial marriage in the Constitution?

Who should "bring forth an amendment"?

No there's not something in the Constitution. ](*,) Are you aware that when the SCOTUS rules on something it's the "Law of the land".

scotus does not legislate

it interprets

it does not make the law of the land, it only settles disputes in reference to the law.

it is not a legislative body. it is NOT the law of the land.

we have ... well .... laws that are... well... the law of the land.

Yeah, no shit. That's why a lawsuit needs to be brought forth separately unto the Supreme Court and argued as a basic civil right.

Separate from what???

That's what the Prop8 case is.

Did you know the SCOTUS is an appellate court?

The basic civil rights aspect should be brought into play so that they have a damn good reason to bring forth an amendment.

Who should "bring forth an amendment"?

Yes, an appellate court. The right for interracial couples to marry was being violated so it was argued in court that they had a basic civil right to do so. Which is what we need to do.

If an President wanted to legalize it then the wheels would be in motion for at least a lawsuit which could go to the SCOTUS if and when it was argued against.

And that's the Prop8 case. So now you're saying there is no case for Prop8 and it shouldn't go to the SCOTUS but it's also "what we need to do"?

Who should "bring forth an amendment"? What are you talking about?

The Prop8 case will not fail because the SCOTUS is not yet tolerable for something like this.

laikaNYC, are you unable to say who should "bring forth an amendment" (in reference to you saying "The basic civil rights aspect should be brought into play so that they have a damn good reason to bring forth an amendment.")

The President

laikaNYC, when you say "That's why a lawsuit needs to be brought forth separately unto the Supreme Court and argued as a basic civil right" what sort of lawsuit are you talking about, and how do you think you'd get it to the SCOTUS?

just as a general observation, I am amazed at the tortured logic displayed in this thread to justify the actions of the republican party and their insane agenda top deprive gay americans of their civil rights.

Angle is as anti gay as it gets and it is pathetic that someone who identifies as a gay man or an advocate of civil rights, would even TRY to think of a way to defend what is indefensible.

The President

The President doesn't amend the Constitution.

Yeah, no kidding. But he can introduce an amendment, just like Bush introduced one to ban it.

Of course that's not what Bush did. He urged Congress to do it.

I think you really might be better off just saying you don't understand the SCOTUS or its role. :)

But sadly, that day won't come for the President to do such a thing. Democratic or Republican.
