Unisex bathrooms would solve this whole problem yet they won't even do that.

Being able to go to the bathroom apparently is "special treatment." Men's room should be fee for service, don't want to give those nasty men special treatment - oh wait, they're all dressed in drag hanging out in the Women's rooms...

This is no different from segregated drinking fountains.

No, the point is that if you say that "equal protection" prohibits the state from limitimg who uses what restroom, locker room,or shower, you cannot logocally say protection applies only to those whom you prefer. If it is discrimination to keep out boys who feel like girls, it is clearly discrimination to keep out other boys or men, including older men. Nothing in the Constitution gives Kabluey the exclusive to decide who can use the bathroom, and who cannot. Sure, any of us can say "oh, that's different", but if the state legislature cannot decide which differences to recognize, neither can you. Struggle to be logical.
 
Most boys and men identify as males. That is their gender identity. So, if the state cannot discriminate in showers by gender identity, boys and men have the right to use girls showers.
That is the great weakness of the DOJ case. For them to win, the Supreme Court has to hold that state must either let boys and men shower with the girls or provide separate cubicles for everyone. It will not be enough to provide cubicles for the transgendered, as boys will still have the right to shower with the girls. Far easier to rule that the present separate arrangements is not discrimination if the facilities are equal.

BTW - on unisex restrooms, they can not be prohibited as they are one of the "work-arounds" for complying with the American's With Disabilities Act

BTW #2 - there is a difference between a "bathroom" and a "restroom". A bathroom has bathing facilities (i.e. shower or tub). A restroom contains neither. Please help in clearing up this discrepancy

No, but i say either the state legislature gets to decide what type of "women" can use the mens room or the womens room, OR anyone can use any room. If it is illegal to keep trans "women" out of the girls shower it is illegal to keep any boys or men out of any girls or womens room because of their male gender identity.
BTW i can't wait until Hussein"s beloved muslims find out that their daughters have to dress and shower with biological men.

So, you don't agree with Equal Protections. You agree with state legislatures having the right to enact any kind of discriminatory law at their discretion.

I've never heard of a problem being caused by that long-time practice. NEVER. Not even once.

I'm sure there have been problems - not every human interaction everywhere in the world is reported in the news - but I guarantee these laws will cause massively more problems, assaults, or perhaps even killings. (Think STAND YOUR GROUND states - "But, officer I think he's a guy but he looked and acted like a woman. I was so scared for my life...so I shot him.")

Um, sort of like voters committing fraud...which almost never happens, but appears to be more "common" (or should I say slightly-less EXTREMELY RARE) than problems caused by people choosing to piss or shit in the bathroom that matches their sexual identity.
