I don't fully understand the US justice system, but I believe that New York state doesn't allow the death penalty. Is the death penalty possible in this case because the alleged offence is a federal rather than state matter? What determines federal or state?

Yes, exactly. Democratic Presidents stop death penalty requests on Federal cases. Republicans reinstate it. It was reinstated the last time by Bill Barr under the first Trump Admin. Biden suspended DOJ filings for death in Federal cases. Trump reinstated it. Bad timing for Luigi... or wrong targets, as the case may be.

In addition to the New York state charges, Mangione also faces 4 federal charges:
  • one count of using a firearm to commit murder
  • one count of interstate stalking resulting in death
  • one count of stalking through use of interstate facilities resulting in death
  • one count of discharging a firearm equipped with a silencer to commit a violent crime
 
LOL. They have to find a jury willing to find him guilty. Judging from the cheers in NY audiences anytime his name is mentioned, that might not be an easy task.

It takes so long in the US to conduct a death sentence, Trump is highly unlikely to alive by the time Luigi shuffles off this mortal coil.

And, there is always the chance he could become a cause celeb in decades to come, and all the reality of his crime will be whitewashed, like the Menendez brothers, and a clear-cut first-degree felony murder will be whataboutismed into clemency.

I'll defer to actual lawyers, if we have any on the site, but in cases of murder, the state and feds decide which case will be prosecuted. You can't have double jeopardy, so the state cannot acquit you in a murder trial only to have the feds convict you of the exact same crime (act). That would be the very definition of double jeopardy.

I don't believe they can just dance about differing specific charges for a single act. Just a layman's guess.

The Feds are usually very conservative. They never want to go to trial with a case that they will lose. That's one of the reasons that they sometimes start high and then settle out-of-court for a lesser charge so that they don't go to trial.

The public is showing itself to be very anti-elitist. Even though Mangione was from a wealthy family, the public seems to see him more as a "V for Vendetta" or Robin Hood type character who killed someone who was an awful person. That really makes me wonder if the Feds would ever be able to get a murder conviction out of a jury.

Trump sometimes appears to play chess when he's actually playing checkers. Treason requires that the country be at war. Trump is in court arguing that the can use the Alien and Sedition Acts because the country is being invaded and is at war against the invaders. 🤔

I'm not a lawyer and at the risk of sounding like a Holiday Inn commercial, I did take business law classes as an undergraduate. In law, "double jeopardy" only applies to the same venue. "Dual sovereignty" creates separate venues for Federal and State charges. This means that you can be charged for the same crime at the Federal and State level and then have to go through separate trials in a Federal and State court for the same crime, as long as they can find individual State and Federal laws to charge you under.

I think this is what happened with Derek Chauvin, the cop who killed George Floyd. He was charged in Minnesota with murder and was found guilty. He then pleaded guilty to Federal charges. The Feds weren't able to charge him with a capital crime, so they charged him with civil rights violations. If Trump were to pardon Chauvin, he will remain in prison because he was found guilty of murder at the State level.
