The indictment unsealed Friday said that over the course of 2022, the government recovered a total of 337 documents from Trump. Of the 31 at the center of the case, the indictment said 21 of them were marked “Top Secret,” nine were marked “Secret,” and one contained “no marking.” One 2020 document concerned the “nuclear capabilities of a foreign country,” according to the indictment.
"Recent media reports have generated a large number of queries about Presidential records and the Presidential Records Act (PRA). The PRA requires that all records created by Presidents (and Vice-Presidents) be turned over to the National Archives and Records Administration (NARA) at the end of their administrations," according to the statement released by the National Archives on Friday afternoon.
38 counts totalWorth noting: yesterday's reporting said that Trump would be indicated on 7 charges. That was wrong. Trump faces 31 counts of willful retention of national defense information
Meanwhile, NARA had to put out a statement:
Exactly. The leak yesterday counted the 31 counts as a single charge. It's not. The way that it's described in the indictment, these are 31 individual incidences of Willful Retention of National Defense Information and each is a separate charge.38 counts total
1-31 are for willful retention. read pages 46-49
here's the indictment
Charge | MaxTerm | MaxFine |
| Willful Retention of National Defense Information - charges 1 through 31 | 10 years | $250K |
| Conspiracy to Obstruct Justice - charge 32 | 20 years | $250K |
| Witholding a Document or Record - charge 33 | 20 years | $250K |
| Corruptly Concealing a Document or Record - charge 34 | 20 years | $250K |
| Concealing a Document in a Federal Investigation - charge 35 | 20 years | $250K |
| Scheme to Conceal - charge 36 | 5 years | $250K |
| False Statements & Representations - charge 37 | 5 years | $250K |
This will do serious damage. A conviction would end it all, but that is a long way off and no guarantee.
There's three ways this plays out:
- Trump takes a plea deal. The possibility of this coming with time in prison might kill this option.
- Trump fights the charge and likely will die before he goes to prison.
- Trump tries to flee the US.
I think the rule is that a non-unanimous verdict would result in a hung jury which triggers a do-over trial that starts from the beginning with a new jury. If the second trial also has a hung jury, then there could be a mistrial, or yet another trial....
The Grand Jury does not require a unanimous decision though, and a criminal conviction does. Hostile judge, Florida jury - mistrial. This is going to go on forever.
