Worth noting: yesterday's reporting said that Trump would be indicated on 7 charges. That was wrong. Trump faces 31 counts of willful retention of national defense information

The indictment unsealed Friday said that over the course of 2022, the government recovered a total of 337 documents from Trump. Of the 31 at the center of the case, the indictment said 21 of them were marked “Top Secret,” nine were marked “Secret,” and one contained “no marking.” One 2020 document concerned the “nuclear capabilities of a foreign country,” according to the indictment.

Meanwhile, NARA had to put out a statement:
"Recent media reports have generated a large number of queries about Presidential records and the Presidential Records Act (PRA). The PRA requires that all records created by Presidents (and Vice-Presidents) be turned over to the National Archives and Records Administration (NARA) at the end of their administrations," according to the statement released by the National Archives on Friday afternoon.

Exactly. The leak yesterday counted the 31 counts as a single charge. It's not. The way that it's described in the indictment, these are 31 individual incidences of Willful Retention of National Defense Information and each is a separate charge.

Republicans are going to try to play the "what about" game - citing Biden, Pence, Hillary. There is no "what about" for this. It's big.

A rational human being would have negotiated for a plea bargain before this was charged. But a rational person wouldn't have gotten charges #32 through #37 which are the cover-up for charges #1 through #31.

Also of note: there's a charge involving conspiracy. That's not a standalone charge. Conspiracy involves 2 or more people. That leaves the door open for DOJ to charge other people. Walt Nauta is one of those people who is cited in several charges, including conspiracy. Conspiracy is one of the 20 year charges, so hopefully either he will get his own lawyer (and not use the lawyer paid by Trump) who will give him better advice or he's going to be going to prison for a very long time in order to cover-up Trump's crimes... like Flynn, like Cohen, like Weisselberg, like...

I keep going back to these three options:

There's three ways this plays out:
  1. Trump takes a plea deal. The possibility of this coming with time in prison might kill this option.
  2. Trump fights the charge and likely will die before he goes to prison.
  3. Trump tries to flee the US.

Yesterday, when it sounded like there were 7 counts and, based upon the pictures that had been released after the raid there was a box, or two, of stuff, I would have said that Trump will fight the charges and will die before the appeals are done, so that he never goes to prison.

Based upon what I read, Trump's only hope is that a judge will rule that the former President is not like you or I, and is not accountable to the rule of law.

All it takes is for Trump to be found guilty of say, 2 of the 37 counts. Let's say that the max on those two counts totals 40 years but the judge gives him 10 years in prison. Trump is 76 years old. No matter how this plays out, he dies in prison or waiting on appeals.
 
At this point, it would be stupid not to file charges against Trump for January 6th and Georgia.

The ridiculous thing about all of this is that the idiot did it to himself. He just had to open his maw and convict himself. The Fed was looking for any reason to settle this, Toad just wouldn't have it. Plus he was going to sell what he could, and probably did, so I still think he's not charged for the totality of his crimes.

The Grand Jury does not require a unanimous decision though, and a criminal conviction does. Hostile judge, Florida jury - mistrial. This is going to go on forever.

I think the rule is that a non-unanimous verdict would result in a hung jury which triggers a do-over trial that starts from the beginning with a new jury. If the second trial also has a hung jury, then there could be a mistrial, or yet another trial.

There's 38 charges. They'll find him guilty of at least one. One is all it takes for him to become a convicted felon.

Three things will influence what happens from here and it's all connected with this judge that they appear to have drawn again:
  1. The voir dire works well without judicial influence and they do get a jury that pressures all members to accept the evidence which is pretty damning.
  2. The judge's rulings on pretrial motions is going to be important. Testimony from Trump's current and former attorneys is cited in the indictment because of the crime-fraud implications; Trump was trying to get the attorneys to commit crimes (i.e. conceal evidence, obstruct justice). That decision to allow the testimony came from the DC Circuit. If the Florida judge disallows the testimony from the attorneys or rules on other pre-trial motions that would benefit Trump, we're more likely to get acquittal on more of the charges around the conspiracy and obstruction of justice.
  3. The judge will guide the jury to a decision by defining the criminal statutes in the instructions that are given to the jury. For example, if the judge were to instruct the jury that the Government must define how the law applies to a former President, then that could bias the jury toward an acquittal on some charges. On the other hand, if the judge states the law fairly and tells the jury that they must evaluate the evidence to determine if the law was violated, then Trump is screwed. Remember: most of the evidence that will be presented in a trial will be Trump's own words admitting that he took the documents, which is 31 of the 37 counts.

Looking at the forest for a moment, Trump is going to have a trial in NY state for the Stormy stuff. Georgia is going to indict him and a bunch of other people who are going to testify against him to save their own ass. Lord knows what will come out of the Jan 6th investigation which will be heard in the DC Circuit.

Trump has D-list attorneys. He's fired so many attorneys and he's allowed his minions to interfere with the prior attorneys. I don't know how on earth he's going to be able to get the army of attorneys who would be able to bail his orange ass out in Florida, DC, NY and Georgia. His goose is cooked.


Other evidence that I offer to support my suspicions: Two former US Attorneys have entered the Republican primary race (Christie and Hutchinson). I think they smell blood in the water. It wouldn't surprise me if the Republicans try to replicate what the Democrats did in 2020 to consolidate behind a single candidate to knock Trump out of the running. I think they know that Trump can't carry the swing States and they don't want to have another down-ballot wipeout in 2024.
