I've heard the lawyers say that juries generally hand out harsher fines than judges. On the other hand, at a civil jury trial, you only need a few holdouts to hang the jury. I'm nor sure what the proportion is in NY but I think it's 2/3rds.It's New York, right? A jury trial would probably be worse.
