Verdict reached in Dharun Ravi webcam spying trial

This was never a very good case to be the first major trial of anti-gay hate crime laws. There were too many complications. And Dharun Ravi doesn't make a very good poster boy for homophobia. I would have liked to see him do more like a year, but I can live with this verdict. And now maybe we can all move on.
 
Only 30 days of jail time is an unbelievable light sentence and the isn't based in the law. I didn't want to see Dharun get the maximum prison term, but 30 days is ridiculous. The judge re-victimized the victims by handing out a slap on the wrist. It's no surprise that the prosecution is going to appeal the sentence. The charges were so serious that Dharun could have been sentenced to more than 60 years in prison. Dharun was convicted on several charges that carried a presumption in New Jersey law of a 5 to 10 year sentence. The judge didn't provide a good legal basis for departing from the presumption and therefore I believe there is a good chance the sentence will be overturned on appeal.

Tyler's parents and several gay rights groups argued for leniency in sentencing.

I watched Tyler's parents at sentencing today and I don't believe they asked for leniency. They had previously asked for it as a way to avoid the pain of a trial and that's what they said today. They didn't ask the judge for a harsh or lenient sentence, but did speak about all the pain they went through.

Note also that the penalty carries substantial non-confinement requirements that will be to greater benefit than a crucifixion.

I have no issue with the entirety of the judgement, which includedm $10,000 fine for bias victims, 3 yrs probation, 300 hrs community service.
 
Wow. Hey judge, why don't you just come to our houses and spit on our faces while you're at it? Seriously, 30 days for the death of another human being? You can't say Ravi doesn't deserve a harsher punishment. He violated someone's privacy multiple times and never once apologized for it. There is not a single shadow of a doubt that Ravi is guilty of so much wrong here. You can't say he couldn't have known Tyler was going to kill himself. There are literally millions of court cases in history with people not knowing their actions would lead to someone's death and they still got waaaaay worse than 30 days. The fact that you pulled a bullshit stunt to begin with is worthy of a pretty big punishment in itself.

Give Ravi a year, maybe even 6 months for all I care. But in this day and age of easy access to people's privacy, this kind of precedent where they're basically saying there's little to no consequences for such actions is absolutely terrifying.

Regardless, it's the message this punishment sends that rattles me. You still had some punk kid film someone and share that footage without permission. He put an innocent person "out there," subjected him to other people's intimidation, and 30 days is all he gets? If that's the case here, then I'm scared just posting on this forum. Seems like as time goes by, more and more stuff becomes "fair game."

You have to remember, it wasn't just about illegal spying as you put it. If that's all he did once and it wasn't biased based, the sentence wouldn't be so outrageous. Of course he did it more than once and he was convicted of it being biased based. Let's set those aside. The multiple counts of evidence tampering, witness tampering and lying to the police should have brought some serious prison time on there own. Not considering Tyler's death in anyway, Dharun could have received over 60 years in prison if sentenced consecutively. He was convicted of very serious charges, it wasn't just a little spying on his roommate.
 
this judge needs to be removed from the bench. he's either homophobic or incompetent. I actually think its probably both. Rhavi hasn't shown any remorse or apologized. There's no doubt in my mind he doesn't think he did anything wrong. This is an inconvenience to him. He doesn't give a shit that his actions lead to someone killing themselves. Hopefully he will get the sentence he deserves but the judge needs to go. idk if he's elected or appointed but hopefully his superiors will relieve him of his duties.

The ones who got rich are the lawyers and the jail owners.

This sort of case is a clear cut of invasion of privacy and nothing else.
The police should be in charge of the case, give Ravi a penalty and that is end of the story.

These stupid cases actually make America poorer ...

Yes, this IS a true story. I guess being black was enough in the 80's.
He went on to start his own business, btw, and is doing just fine.

And this creep gets 30 days....

I do think that the punishment was not equal to the crime. However if Dharon has any conscience and I'm hoping he does... Then he will atone for his actions one way or another. If not, the rest of the world will not let him forget.

As well as the jail term, Ravi is to serve a three-year period of probation and complete 300 hours of community service.

He must also pay $10,000 (£6,330) to a state-licensed community organisation that helps victims of bias crimes, and complete a programme on cyber-bullying and alternative lifestyles.

Judge Berman said part of the reason he was not recommending deportation was because the man who was videotaped with Clementi - known as "MB" during the trial - had written a letter asking that Ravi not be deported.

Dharun not expressing remorse hasn't bothered me too much. I figure he is following legal advice not to say anything that would appear to admit guilt. They are appealing the conviction and may have a new trial. Additionally, he has deportation to worry about.

What bothers me more is that he didn't show (with his body language) any remorse or emotion, except when his mother was crying while making her statement to the court. At least it showed he isn't completely heartless. Too bad he didn't show some emotion or tears while Tyler's parents were addressing the court.
