What is new on the Gay Marriage front?

It appears that no one in Kansas thought to file a suit challenging the ban.

The ACLU announced that they would file, but it is unfortunate that it hasn't been done until now.

Amendment One has been lifted in North Carolina

A federal judge in North Carolina’s Western District has issued an order permanently prohibiting defendants in a United Church of Christ lawsuit against North Carolina’s anti-LGBT amendment from enforcing the ban. Additionally, the judge denied Republican state leaders’ motion to intervene in the case.

The Kansas Supreme Court has put a temporary hold on the granting of marriage licenses to same-sex couples in Johnson County, but allowed applications for such licenses to continue. (For background, see Post #1736.)


In response to a request from the Kansas attorney general earlier Friday, the court issued the Friday evening order refusing to grant the attorney general’s request for an immediate order that the licenses could not be issued — noting that “the Attorney General’s right to relief on the merits is not clear.”

Instead, the Kansas Supreme Court granted the temporary stay and set a schedule for a full briefing of the issues involved — including the question of “whether Kansas’ state constitutional, statutory, or common law bans on same-sex marriage are permissible under the United States Constitution.” Oct. 10, 2014, at 7:19 p.m.

As I read the order it indicates a predisposition to overturning the ban.

No one in Ohio has challenged that state's ban on gay marriage, either.

There have been two challenges only: One to force Ohio to record gay parents (married elsewhere) on birth certificates, and one to force Ohio to record gay spouses (again, married elsewhere) on death certificates. The state's constitutional ban on gay marriage has not been challenged in court. Nor is there at present any attempt even to get the issue on the ballot.

Gibson v. Himes is the case brought by a couple that wants to marry in Ohio. It was stayed on August 4 pending the decision expected from the 6th Circuit. Once that occurs Judge Barrett will issue the appropriate orders.

It is the mandate that the 9th Circuit needs to reissue. The governor of Idaho really didn't need to fuck with us, especially when the likelihood of succeeding an appeal is practically nonexistent.
 
Shame it took this long but then again, having family that lives there, I imagine it was quite the challeneg to find a couple willing to risk housing a job etc to fight the ban

I've seen that cited as one of the major difficulties is just finding plaintiffs willing to splash their private lives all over the media, as well as the time and the energy to go through litigation, which can take years. On that note, it should be easier now that there is little need for court dates in these states, national organizations are picking up the tab, and the process is weeks instead of years.

The situation is so fluid and moving so fast - even on a Sunday, no less - that anyone giving a count should put a date and time on it.

(And the 9th Circuit has briefs on Idaho due tomorrow, a Federal holiday.)

Depends on your definitions. You can presently obtain a license from 29 states, but that is going to rise soon and at any time. That is because the theoretical legality is somewhere between 35 and 40.

During the October 12 edition of "Huckabee" on Fox News, the former governor blasted Thursday's Supreme Court ruling that recognized the constitutional rights of LGBT individuals, The ruling now allows the states that had appealed, Utah, Oklahoma, Virginia, Wisconsin and Indiana, to all recognize same-sex marriage in their state. Huckabee called the decision a "betrayal of our Constitution," and that he was "utterly disgusted" with the Republican governors who complied with the court's orders.
It's obvious that Mr. Huckabee is unaware of the 14th Amendment to the U.S. Constitution (equal protection under the law.)
