The justices and particularly their top notch clerks were well aware of what they were doing on October 6. Does anyone honestly think they wanted to toy with the marriage laws of three dozen states only to reverse them at a later time?
 
So can Scalia and Thomas' "dissents" be seen as "We're going to lose here, and we DON'T like it!"?
 
The momentum is building. Scalia can't get past his pre-Vatican II Catholicism, unlike most of us in the Roman Church.
That is not a valid argument against equal protection now that we all understand that "it" isn't a mental disorder.

"They" may have just voted us back to a fiscal cliff in time, but they can't stop this train from hitting Grand Central at full speed.

What is interesting is that Roberts and Alito did not enter a dissent.

But neither did Scalia or Thomas object to lifting the stay in Idaho, as I understand it (decision was unanimous).

Indeed. To me it indicates that this may not be a 5-4 decision after all.

I'm not holding my breath. I still think it will be 5-4 with a small, small chance Roberts will make it 6-3.

Phil Bryant. At the same time, he appeared sympathetic to the plaintiffs who want the ban overturned.

According to the article, Judge Reeves has a background in civil rights activism.
 
Ummm ..... wouldn't a state AG realize that a federal court order trumps their state supreme court? Does the circuit court now need to clarify that marriage has arrived statewide? These guys REALLY do look like the "Segregation Now! Segregation Forever!" crowd of yore.
 

It appears that only Johnson County is holding off since they are technically barred by the State Supreme Court until the injunction is lifted. This is similar to what happened with the county that jumped the gun in Pennsylvania. I expect it to be resolved by the end of next week.
