This order only applies to marriages performed in other states. A challenge to the state's same-sex marriage ban is pending.

Now that there is a pending matter before the 5th Circuit I think we may find out how far GOP appointees are willing to go. They may also use the latest appeal to try and quench our progress or put a dent in our winning streak.

Which will likely result in guaranteeing the Supreme Court hears the pending cases next year if there is a circuit split.
 
I think there will a split. The 5th circuit isn't just stacked with conservatives, it's stacked with conservatives of the Thomas and Scalia mode who pull stuff out of their butts to justify their bigotry or far right views.

Neither Thomas nor Scalia are conservatives -- they're not honorable enough to be. They're self-righteous reactionaries.

It will continue like this until the Supreme Court takes a case. In fact, this whole strategy of filing roughly 50 cases appears designed to shock the high court into submitting to a decision it can't back out of, and in which its hands are tied.

Yeah. Theoretically they could tell all the circuit courts they were all wrong, but it isn't likely when there's massive agreement.

If Republican appointees continue this unanimous chorus (I shouldn't be so glib; it is not guaranteed), then they will seal the deal. The next great opportunity to do that will be the decision in Michigan from Judge Friedman.

Even if there are dissenting voices in coming months, the preponderance of districts issuing such stern decisions cannot be ignored by the high court, if only because a reversal will not quiet them, but make them even more resolute than they were before as the culture moves forward.
