Guess Mike Huckabee doesn't agree with Federal law. He's supporting her decisions and will be visiting her tomorrow. I dislike both of these people.
 
If her objection was based on her religious beliefs, then she should of quit her job.

Mr. Huckabee will reap his own reward. If he holds his extremist position long enough, it will eventually schism the GOP, which will in turn strengthen the Left. This divorce is long overdue.

I hope he carries this coal to the GOP convention, as it will prove a disaster when it comes to forming a moderate position that can be defensible.

This disaster is like a gift from God for the Left. It wasn't enough for the GOP to piss off all the Latinos AGAIN, so now they've reminded the majority of America how opposed they are to the majority on gay marriage. Nice.
 
I heard on the news that the job pays $80,000. per year, if she really believed it was wrong to issue marriage licenses she would resign, except that it seems like the love of money enters in.
 
Huckabee, with his far right rhetoric, has eliminated himself (or should) for presidential candidate. If he is not smart enough or unrighteous enough to realize that the Supreme Court rules on the constitutionality of law and is a co-equal branch of government -- not creating laws but interpreting against the constitution then he might want to run for pastor in chief instead of president.

The new code is that the supreme court "created law" that does not have to be obeyed until acted upon by another branch of government. All it would take is a simple study of constitutional law and the history of the United States to make them look even dumber than what they attempt to make themselves. As for Kim Davis' attorney, he's been called out by the likes of FOX news as "obtuse." I personally liked the guest of the FOX news segment who said the attorney wasn't "obtuse" but instead "stupid."

U.S. District Judge David Bunning ordered the immediate release of Rowan County clerk Kim Davis, who spent the Labor Day weekend in detention following her repeated refusals to comply with an order to issue marriage licenses to eligible couples within her jurisdiction.

The judge reached his decision after receiving a status report from the plaintiffs in the case -- same-sex couples who sued Davis after being refused marriage licenses following the Supreme Court's June ruling legalizing same-sex marriage nationwide.

In the order, Bunning noted he was "satisfied" that Davis' office was "fulfilling its obligation to issue marriage licenses to all legally eligible couples," in accordance with Supreme Court precedent and an August order in which he forbade Davis from enforcing a "no marriage policy" that effectively kept all couples -- gay and straight -- from obtaining marriage licenses.

Bunning's order Tuesday made clear that Davis must "not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples," and that any such interference would result in "appropriate sanctions."

The judge also ordered the deputy clerks who are issuing marriage licenses in the place of Davis to file status reports with the court every two weeks so as to ensure compliance with the court's order.

So, basically, now, the county clerk's office not only has to issue marriage licenses to any couple - gay or straight - who shows up on their doorstep and pays the fee to obtain said license, but now, they basically have to document it and prove it to the court that they are indeed abiding by the law.

The judge is wise. By releasing her when he did, he averted the presidential candidates from having their photo op with her in jail.

Let's see if she is smart enough to not defy the court again. I say there is less than a 30% chance she is.

The news media always covers things in 30 second sound bites. There is much more to being a clerk than just issuing marriage licenses. A clerk in Kentucky also issues vehicle registrations, is the official record, and ensures taxes and other fees are property distributed:

There are some significant issues that have been glossed over and that should probably be looked at by media:

• The governing body of each county must adopt, by ordinance, a code of ethics covering all elected county officials, including the county judge/executive, county clerk, county attorney, sheriff, jailer, coroner, surveyor, constable, and members of the governing body. (KRS 65.003) … Each code must contain standards of conduct, financial disclosure requirements, a policy on nepotism, (I believe Kim Davis’ son is employed in the office) and the designation of a person or group to handle enforcement. Other provisions may be included. Once a code has been enacted, it may be amended but may not be repealed.
• KRS 67.710 designates the county judge/executive as the chief executive of the county. The judge/executive is specifically charged with executing all ordinances and resolutions of the fiscal court, all contracts entered into by the fiscal court, and all state laws subject to enforcement by the judge/executive or subordinate officers. KRS 67.083 provides further that the county judge/executive may exercise all executive powers pursuant to this “home rule” statute. The county judge/executive has the primary responsibility for the administration of county government. In this regard, the office has the authority to create, abolish, or combine any county department or agency and to transfer functions from one agency or department to another. Any plan for reorganization, however, must be submitted to the fiscal court; unless disapproved within 60 days, the plan becomes effective (KRS 67.715).
• County judges/executive may perform marriage ceremonies. They may also authorize justices of the peace and fiscal court commissioners in their respective counties to perform marriages (KRS 402.050). In the absence of the county clerk, the county judge/executive may issue a marriage license (KRS 402.240).
• The county clerk issues marriage licenses (KRS 402.080) and files and records all marriage certificates (KRS 402.220 and 402.230). Military discharges may also be recorded in the county clerk’s office (KRS 422.090). On or before the 10th day of each month, the county clerk reports to the state registrar of vital statistics all marriage licenses issued and all marriage certificates returned (KRS 213.116). Each county clerk must furnish each applicant for a marriage license with a copy of a marriage manual to be prepared and printed by the Human Resources Coordinating Commission of Kentucky (KRS 402.270).
• Any clerk who knowingly issues a marriage license in violation of KRS Chapter 402 shall be guilty of a Class A misdemeanor. Any clerk who knowingly issues a marriage license to any persons prohibited by KRS Chapter 402 from marrying shall be fined $500 to $1,000 and removed from office by the judgment of the court in which convicted (KRS 402.990).

Some martyr - Gays, not Christians, are still America’s truly embattled minority

JAILING Kim Davis for five nights has made her a misleading martyr to a misguided cause. Ms Davis is a clerk in Kentucky who adamantly refused to dispense marriage licences to same-sex couples. Her offence—to break the law in order to preserve her conscience—was even more wrongheaded than her punishment. Though she is now free again, her supporters, including several Republican presidential candidates who ought to know better, see her brief incarceration as the brutal triumph of secular tyranny. They exaggerate both Ms Davis’s nobility and the threat faced by Christian America.
