Depends on the prosecutor. Some acts can be criminal. But from what I've been told, smashing windows and walls are civil. They said they can probably make the shoving cement down the drain a criminal case. We just have to wait and see.
 
Sorry this happened. There is no doubt that criminal activity took place. The problem is in proving who did it. Being an evicted tenant might provide motive but with no eye witnesses it's a circumstantial case that the prosecutor might not want to spend time or resources on.
Well, I got that covered. The dumbass has been texting everybody he was going to do all the things he ended up doing, including shoving cement down the drain. No problem proving intent and action.

Depends on building commissioner. Again, I wasn't going to rent that out. He was kicked out by his ex so he needed a place asap. His son has been a tenant of mine for years put in a word for him. So I fast tracked a CO and put him in there. All that was needed done was some painting and baseboards.

Unfortunately, now I gotta get some people to dig up under the house to install new sewer lines. Fortunately, he left the waterline intact and the electric mostly intact.

Nah, this is indiana. The law about guns is as long as you are not a convicted felon of a violent crime you can own as many guns as you want and carry around whatever you want. The state does offer permits and stuff. But no one is required to have a permit to own or carry.

You don't understand the nature of the legal jeopardy you exposed yourselves to then. It wasn't about permits to run around and carry guns. It was about if one of them had been used.

But as you say, it is Indiana, so if he had been there and one of your posse shot and wounded or killed him, I am sure there wouldn't have been any consequences of extra-judicial justice. As you say, it is Indiana.

It was for self defense only. We weren't out looking for him to shoot.
 
I'm just saying that next time, you should look to the police or to a security company when you decide to re-enter your property and you feel there may be a threat to your safety so that if there is an incident, there would be no question of self-defense versus vigilante justice. Just Dutch Uncle advice.

My cousin has a problem with a resident. He is president of a home owners association for a cooperative where every resident owns a share of the whole. He keeps getting calls from other residents complaining about one resident who is not mentally balanced. She hollers and curses and swears outside and inside which disturbs her neighbors who can hear her, she feeds animals and one neighbor was threatened by a deer just going from her car to her residence, she blocks her dryer vent and puts stuff in her electrical outlets to block evil spirits from entering through the cracks, which is a fire hazard, she runs water for hours, the homeowners association pays for the water, she complains about the lasers across the street, although there are no lasers across the street, and now she is again behind in paying her monthly service fee because the bank has block her account because the aliens have been putting suspicious charges on it. They were going to evict her some years ago, but her relatives paid her back charges because they didn't want to deal with her. The local police have been called by neighbors numerous times because of her disturbances and they know her name. Several months ago the police took her to a hospital where they kept her 30 or 40 days and then released her. My cousin has again legally filled to get her evicted, but there is no place for her to go if this goes through. I don't think there are any insane asylums around to take her and no one will want her in an apartment or group home because she will be a disturbance for the other residents. I called Catholic Charities and they will help her with her first month's rent in a new place if she asks, but I doubt any place will take her. Where can she go if she is evicted? They have enough legal charges to evict her. Thanks
 
Well, in Ontario, if your cousin and the homeowners gave a shit, they could probably with the aid of the police, seek social services support to either help her stay where she is or to find her supportive care.

The asylums were closed down to push the mentally disturbed back into the community, which is actually a good thing for some of them. But certainly there are never enough supports in the community to keep so many from falling into the cracks.

What your cousin and the neighbours are doing is making her homeless. It is as simple as that. Because she is inconveniencing them.

And I guess in their community it is okay to shun and eject her.

I was a founder and Director of a housing co-operative in Toronto in the 80's and we had our fair share of mentally ill and challenging residents. In each case, our property manager and the Board would try to work with the families and the primary physicians and social services to make sure the people were being looked after.

Only in one case that involved massive alcohol and drug abuse did we terminate their tenancy because of non-payment and abusive behaviour. And they killed themself. And I have felt remorse and guilt about that ever since.
 
I've been going back and forth between posting this and not posting this. I seriously doubt this affects anything. So here goes.

Last week, I went in to check on the status of the police report I filed on the theft. Yes, there's been more to this than just a normal eviction case. Basically speaking, I found out this guy has been behind a series of thefts at my places. So, I kept pushing and pushing until I got to the captain. It's not as impressive as it sounds since it's a small PD. He pulled up my file and said it's been labeled as inactive. The sob sergeant I filed the report with never did anything with it.

I pointed out in the files I turned in that I got a confession of at least one of the thefts in writing. He apologized to me and said he will now turn everything over to a detective and promised me a detective will reach out to me this week.

Sure enough, Monday came and I got a call. I set up a time and earlier today we met in an interview room. He had the camera on me and everything.

The point is this. There are now 3 separate police reports regarding the same person from me, including the property damages. If the property damage was it's own thing, most likely it would fall under a civil case. But the detective now is trying to combine the 3 cases to establish a pattern. They could combine the property damages and missing appliances with the other 2 theft incidents and make this whole thing a big felony charge.

The detective also asked me if he's been trying to talk to me and I told him the guy been texting me but I've been ignoring the texts and not read them. He recommended I read them to see if there's anything incan use in there. I started reading them and apparently the guy has been blowing up my phone with stuff like if I don't let him stay there he will accuse me of inappropriately touching him and forcing him to have sex with me. He also tried several times to try to pay me money to stop the charges. Suffice to say, I just emailed the detective the everything the guy texted me. Could result in more charges like witness intimidation and such.

Like I said, I don't see how me telling you guys this might affect the case. Hey old wise mod, if you think it is unwise of me to post this here, please delete this. I know the guy I'm going after is homophobic as fuck so doubtful he would visit a gay porn site. And even if he finds this, it's pretty much written in stone. I'm gonna push for this until he gets convicted.
 
Telling us about any of it probably won't affect the case. But don't worry about that. We're the ones you share stuff like this with, and you've gotten enough support here about this mess that I think it's safe to say that we're glad to be your listeners/readers.

I'm glad you found out that he's behind those thefts (can't say I'm surprised). I'm glad you pushed to talk to the captain. I'm even glad he texted you that nasty stuff, because it's additional evidence, and it's proof that he knows that any sexual misconduct he may allege about you is bogus.
