Florida will see same-sex marriage starting Jan. 6

It’s official – same-sex marriage is legal in Florida come Jan. 6.

Federal Judge Robert Hinkle – who ruled the state’s ban on same-sex marriage unconstitutional back in August – has issued his order on the scope of his ruling.

“The founders of this republic adopted a Constitution and a system for its enforcement,” Hinkle’s ruling reads. “When there are disagreements about what the Constitution requires, those who are affected may seek a definitive ruling in court. These plaintiffs did that in this case. The Secretary and Surgeon General—as duly empowered officials of the State of Florida, represented by the Attorney General—joined issue. So did the Clerk. The result was an explicit ruling that Florida’s same-sex- marriage ban is unconstitutional.”

Hinkle’s August ruling that the ban is unconstitutional came with a stay, set to expire end of day Jan. 5.

“The United States Supreme Court and federal courts of appeals had stayed similar rulings in other cases,” the Jan. 1 ruling reads. “I stayed the ruling in this case while those stays were in effect and for 91 more days—long enough to allow the defendants to seek a further stay in the United States Court of Appeals for the Eleventh Circuit and, if unsuccessful there, in the United States Supreme Court. The defendants did that. They lost. The United States Supreme Court allowed the ruling in this case to take effect.”

Despite that, the Florida Association of Court Clerks and Comptrollers attorneys twice warned that Hinkle’s ruling only applies in Washington County, and clerks in other counties could face criminal charges if they issue licenses.

Since then, clerks in most Florida counties either stated that they’d hold off on issuing licenses until a court order clarifies the issue.

“I am thrilled that Judge Hinkle has emphatically announced that his prior ruling establishes that the Constitution requires ALL Florida clerks to issue marriage licenses to same-sex couples beginning January 6,” said attorney Mary Meeks, a member of the legal team behind a Florida lawsuit fighting for marriage equality. “There was never any legitimate confusion about that, but now the anti-fay forces that created the false confusion have no more excuses. Let the marriages begin!”
 
All 67 clerks have now said they will issue marriage licenses come Tuesday.
I can't wait for that day.

I'd vote for that law under one condition: that it require them to post their religion and the church/assembly they go to, on an official sticker with a big black fist flipping the bird on it.

And the sticker would cost $500 a year.
 
Sadly, I know. I have a lot of relatives in that state, including a cousin who is openly gay and got married to his partner on the one day they could before the stay before the refusal to hear the appeal.

Some of them are so "Jimmy Jones Kool-Aid" brain dead they really think the Republicans are their saviours - while concurrently being abhorred by big pig industry tactics and similar in their farm country - which is where they live. Those other people getting the dole - um, what about your dad who flipped his car and was an almost 100% quadriplegic for years? What about your deaf daughter who was offered a full ride to RIT/NTID Room and Board - then fucked it by cutting wild - she wasn't ready for it.

Oh, and give me "my" social security monies I've put in" that the government has squandered - um, I know we'd all like that but it's a pay it forward program. Your money and mine have gone to our grandparents and parents retirements. Oh, and the aforementioned daughter's SSI payments to help with her disability growing up. And, oh by the way, your social security, other than the aforementioned SSI payments, and the early retirement/disability paid to your dad, hasn't been funneled to other plans - like ADM farm subsidies or Big Oil oil depletion allowances, or tax breaks for Romney's company or GE to send millions of jobs overseas because it cost less - check out the # of jobs lost overseas to the number lost in the US from 2007 on BEFORE you add back what has been added since.

Sorry, I know I'm a bit off topic - it's the fucking mentality. This, from my more fundamental "Christian" kin. My gay cousin is perhaps the truest example of a Christian. He moved in with our Grandparents to help take care of my grandfather when he developed Sundowners (precursor to Alzheimer's). My Aunts would trade off a couple days at a time to help, too, but he put his life on hold and lived there to be a full time caretaker. He also came out here to escort my mom on the train when she needed help to visit.

Actions speak much louder than words - and the actions these ignorant assholes demonstrate with their false indignation speak volumes.
 
Sorry to see Pasco (the one above Tampa) on that map, but the others are largely cracker counties. Escambia, Gulf and Walton appear to be tourist-oriented enough to figure gays from GA/AL might be a draw? Note that majority-black Gadsden hasn't followed suit; interesting that Nassau (above Duval, below GA) hasn't either.
 
I think it's more Roberts, than Kennedy, who'd be swayed by that one (outside chance on Alito as well).

I think Chief Justice Roberts (like any other narcissistic Republicon) is concerned about his legacy.
Acceptance of marriage equality is a watershed movement and on a constitutional level would only enhance his legacy. IMHO (wishful thinking) an addition to the Civil Rights Act of 1964 would include marriage equality. One can only hope!
