On Topic Discussion 2 yo boy killed by alligator at Disney

Man, I can't imagine the amount of hand holding some of you seem to need to get through life. Very clear that some of you need to blame everything else in life but never take responsibility for oneself.

#-o I'm guessing that you've never had a horrible incident happen to you or a loved one. Sometimes shit happens but usually there is negligence. I'm pretty sure if a car mounted a sidewalk and mowed over your BF, your attitude might be different.
 
Although the parents were technically responsible, people who aren't familiar with Florida wouldn't realize the seriousness of the danger. When there are no swimming signs in my part of the country, it usually means that there is bacteria in the water or dangerous currents. Some people would consider wading as borderline wrong. Also considering that Disney dotes on children, you would expect them to try to childproof everything. The parents were responsible but it is hard to find anyone at fault. Hopefully Disney will try to safeguard against this ever happening again. The signs should have at least warned of alligators and perhaps a fence would even be a good idea.

My cousin told me when he was visiting his son in Florida there was a couple in a speed boat pulling an inflatable raft behind the boat with children in it in one of the canals in Florida. If the raft had hit a wave or turned over the kids would have been in the water. Yikes! Where is people's common sense?
 
Neither does Canada, but I know enough not to go chasing a golf ball I hook in a water hazard.

Florida has alligators. Deserts have scorpions and rattlesnakes. The west coast has bears. The oceans have sharks. Unless you live under a rock, it's common knowledge. It's not a defence.

People need to take responsibility for their own actions or inactions. It's like someone seeing a 'Beware of Dog' sign on a fence gate, opening it, going in, getting attacked by the dog, and then suing the owner for his injuries. The parents knew the potential dangers. If they didn't, they shouldn't be raising children.

In Florida we have all those things and more.

If that happened should I go after the city because they didn't have signs on the road ways that say "Don't drive on sidewalk"?

Not me. I am a lawyer and know how this will probably play out if the facts are as we understand them. One fact, which might change the result would be if the parents were otherwise warned about the alligators. There has been no suggestion of that yet.
 
For what it is worth, an alligator will leave the water and attack on land, they don't care if you were swimming or not.
There should be alligator warning signs for those who are not familiar with the dangers, not just "no swimming"

Who gives a fuck about blame? A two year old little boy was drowned to death. That is all that should matter to anyone. I can't even begin to imagine the grief and pain his family is going through.

Insurance companies, of course, someone will have to pay for damages/expenses.

And, too, those of us who would like to believe that people might learn from this, and precautions might be taken to make sure that this sort of thing doesn't happen again.

If no swimming signs provokes a response of "But that's not fair, I wasn't warned ENOUGH", the consequences from then on out are most definitely Darwin awards.
 
This is a first for Disney, so I don't buy that they were actually negligent, only technically in the sense that lawyers devise.

I do wish people would read threads before comenting.

The only reason Disney keeps getting mentioned in the media is because it is int he vicinity of DisneyWorld

It does sorta smack of the alleged start of compensation culture when someone sued McDonalds because there wasn't a warning on the coffee cup that it was hot and he burned himself

But life is so hard, when someone or something tells me not to do something or go somewhere I need to do it anyway. Then when something happens it is totally someone else's fault.

In that case the coffee was not "hot" it was scalding hot. The suit and reward were legit.
