No, I subscribe to the barbaric notion that people of age shouldn't be fucking children. Apparently the state of Texas shares that belief with me and other civilized humans.

Blaming the victim is not cool, either.

This is a big piece of the problem with the country: people think they can lie and not suffer consequences. That's what the nation just taught the banks -- and now we have a movement which will hopefully get the government to return to the notion of taking responsibility for one's own actions and not blaming someone else.

Now, the statute addresses the age of the child. Nowhere in the statute does it address what the child may have stated their age to be. So whatever the child says their age to be is absolutely irrelevant.Facts, not perceptions are what the law is based on.

Subscribing to your point of view would allow child molesting rapists to make the argument "She said she was 17." Rape of a child is among the worst things that you can do, so courts don't even permit that kind of idiotic argument to be made.

In most instances, an underage individual lacks the legal capacity to give consent for sexual relations.

You do realize that there is only an allegation of statutory rape, and no proof yet that it is true?

Dallas Police continue to investigate whether a teenage runaway was sexually assaulted by an adult male at the Occupy Dallas encampment behind City Hall.

If she lied about her age, she could be lying about having sex with adult men at the encampment.

Do you ever read articles in their entirety before characterizing what they say? Nothing in the article states that the protesters in Norfolk are clueless as to why they're protesting. It states that they are unsure how the movement will make an impact or how they will achieve their goals.

I'm glad you and jackaroe have such faith in the main-stream media to accurately report what is happening. Maybe you two should reread the article and its source material and decide for yourself how accurate the article is. The news report says that WAVY-TV quoted several people as saying they had no idea how the group would achieve its goals. Hit the jump site in the article to the WAVY-TV story, and you will see that only one person is quoted as saying they had no idea. One isn't several.

No one is defending rape. I, for one, merely pointed out that there is an investigation regarding statutory rape, which does not mean that the story is true.

So you do agree with the barbaric law that requires people to be omniscient.

I know a guy who went to prison for having sex with two minors. He was unconscious at the time, but that was irrelevant. They'd drugged his drink to get him unconscious, but that was irrelevant. They'd gotten into the party with ID checked by cops, that showed they were over eighteen, but that was irrelevant.

Any law requiring someone to be omniscient is foolish. The only people who support such laws are authoritarians that care more for appearances than justice.

No, the statement is correct; the reality is warped by lawyers' games. Somewhere along the line they threw out "willingly and knowingly", and thus shoved over a millennium of common law into the trash.

At the very least, a kid who claims to be old enough for sex in order to engage in it with an adult should spend a year in jail for fraud.

Yes, rape is wrong -- but if you're told your partner is of age, it isn't rape when she's willing.

And don't give me the shit about minors not being able to be willing -- I've seen too many deliberately set out to have sex with older people, notably at fraternity parties where the guys had to hire off-duty cops who couldn't just check IDs but had to have real-time connection to government databases in order to verify if the driver's licenses and state ID and student body cards were for real. I've also run into a dozen or so on line trying to get me into sex with a minor.

Adults should be very, very leery of ever having sex with anyone who looks under thirty, without in-depth verification of age, not just to keep from hurting kids, but for their own sake -- the law here is not rational, but vindictive.
